The Barcelona court held a hearing this Tuesday, March 19, to decide whether Dani Alvesh would be released from prison or would remain deprived of his liberty. His lawyer, Ines Guardiola, not only demanded the immediate release of the Brazilian footballer, but argued that the payment of 150,000 euros in compensation should be very qualifying, so the sentence could be reduced.
Alvesh assured the Court that he would stay in Spain until the process was resolved, adding that his residence was in Barcelona. In addition, Alvesh's defense also offered a new bail of 50,000 euros and daily appearances in court.
The prosecution was against the release of Dani Alvesh, as it said that there was still a risk of escape, given the high economic capacity of the footballer. Dani Alvesh, who spoke at the end of the session, said about his possible escape: "I believe in justice and I will always be at your disposal. I want to go to the end of this matter, I want the truth to come to light".
Today we learn that, if Dani Alvesh pays the bail of one million euros, he can be released, according to "El Perodico". Another condition to be free would be that he not leave Spain. If the payment of the deposit is verified, his two passports, the Spanish and the Brazilian, will be blocked, so that he has no chance of escape.
Also, Alvesh will have to appear every week before the Provincial Court, as well as as many times as called by the judicial authority. Also, the Brazilian cannot approach the girl who denounced him for rape at a distance of not less than 1000 meters from the house, workplace or any other place frequented by her.
The arguments that the court has given: "It is worth remembering that the function of temporary detention cannot in any case be to advance the effects of a hypothetical sentence that may be imposed on the accused, or to promote the investigation of the crime, to obtain evidence or statements, since for such purposes the deprivation of liberty would exceed the constitutional limits recognized in Article 17 of the Spanish Constitution, which recognizes the right of every person to liberty, so that no one can it is removed, but only in the cases defined in the provision in question and in the forms provided for in the law".
