The Helsinki Committee has requested an investigation into the case of police violence against a 14-year-old minor. He was taken to police station no. 1 on April 12 after being caught illegally setting off fireworks near the Kodra e Liqeni area in Tirana.

The Helsinki Committee states that the minor's parents claim that police officers had exercised physical and psychological violence against their son.

From the observations of the Helsinki Committee it results that, according to the reviewed documentation, the minor JG, born on 09.11.2010, on 12.04.2025, at 18:40, was escorted to Police Station No. 1. The reason for the escort was the suspicion of disturbing the public peace and throwing pyrotechnics.

The Accompanying Report noted that the minor had a hematoma on the side of his right eye. The documentation reviewed does not show that he had been seen by a doctor. The above fact was denied by the police officers.

Although the hematoma was noted in the above-mentioned report, it did not result in the minor being visited by the Commissariat doctor, contrary to the provisions of Chapter IV of the Standard Procedure "Treatment and security of persons arrested/detained in State Police premises, recording and resolving their requests/complaints".

At the request of the parents who went to the Police Station immediately after the notification, the Trauma Hospital emergency was notified. The above fact was noted in the relevant register. The minor was accompanied to the Trauma Hospital, on 12.04.2025, at 20:00. According to the accompanying medical epicrisis sent to the AHC by the minor's parents, the diagnosis is: Contusion capitis, punching. To be followed by the family doctor for rest and re-examination according to the referral system.

In the Register of Accompanied Minors, AHC found corrections in the schedules marked in the name of the psychologist and the judicial police officer. In fact, psychologist MT had not met with minor JG at the Police Station, but only at the Trauma Hospital. This shows that the psychologist's name was marked later in the register of the Police Station.

"Considering the above facts, it is concluded that the minor JG was raped, which was evident not only visually, but also in the medical history of the Trauma Hospital. In addition, although the police officers made notes in the register about the hematoma, since they denied the use of violence against him, they did not send him for a visit to the doctor. The minor was taken to the hospital only at the insistence of his parents.

In the above-mentioned case at Police Station No. 1, the minor JG was not provided with the necessary medical and psychological assistance, thus acting in violation of Article 34, point 1, letter c and point 1 of Article 35 of the Code of Criminal Procedure, as well as Articles 10, 14, 18 of the Code of Criminal Justice for Juveniles, which deal with the principle of the best interest of the child, the assistance of a psychologist and the use of alternative measures of avoidance. "While the parents of the minor citizen, on 13.04.2025, have filed a report with the Police Supervision Agency and the Prosecutor's Office at the First Instance Court of General Jurisdiction, Tirana, AHC calls on the responsible institutions to investigate this case with priority and seriousness, in order to fully clarify the incident and prevent similar situations in the future ," the statement states.
