The High Court has today cast lots to review the request of Tirana Mayor Erion Veliaj, who opposes the security measure "prison arrest". The judge assigned to review the case is Ilir Panda.
Veliaj has appealed to the Supreme Court, requesting a change in the security measure, immediate release, and a review of the merits of his claims, without returning the case for retrial to the lower courts.
In the arguments presented, the defense claims that the issue is primarily legal and constitutional, therefore the Supreme Court has the authority to resolve it definitively, without the need to administer new evidence or reassess the facts.
According to the defense, the court must assess whether the "prison arrest" measure continues to be necessary and proportionate, whether the procedural risks have been concretely argued, and whether alternative security measures have been seriously considered.
The request also raises the issue of Veliaj being kept in a glass cage during court hearings. The defense argues that this practice violates human dignity and contradicts the principle of the presumption of innocence, requesting that he not be kept in a "cage" during court proceedings.
Another argument is related to the mayor's term of office. According to the defense, Veliaj was elected for a four-year term, from June 2023 to June 2027, and the continuation of the arrest is making it practically impossible to exercise his duties. According to it, this affects not only Veliaj's personal freedom, but also the right of the citizens who elected him to exercise the function.
The defense also argues that returning the case for reconsideration to the lower courts would lead to procedural delays, risking that a final decision would be issued after a significant part of the mandate had been consumed, which, according to it, would make it impossible to effectively restore the rights claimed to have been violated.
For these reasons, the defense requests the Supreme Court to exercise its jurisdiction, change the security measure "prison arrest" and order the immediate release of Erion Veliaj.
