The head of SPAK Altin Dumani has made a strong statement saying that organized crime has threatened the family of a prosecutor.
During the first meeting of the newest dialogue initiative between institutions and policy actors, "IDM Morning Briefing", Dumani stated that the biggest concern is the threat from organized crime and not the threat from politics, who emphasized that the duty of the Prosecutor's Office In particular, it is to investigate that SPAK members are all prepared to deal with these situations.
"Organized crime has threatened the family of a prosecutor. I am concerned about the threat from organized crime, not the threat from politics. We have also calculated not to return, because this is our duty to investigate. Prosecutors are immune, they are all prepared to face these situations, but in the end we chose this task ourselves", he said.
Altin Dumani has not revealed the name of the prosecutor who was threatened by members of criminal gangs.
"From the beginning, I would not agree with you when you say that he has made history, he has done nothing but fulfill his constitutional obligations against corruption and organized crime. Despite the fact that we have entered the fifth year, we must evaluate the activity, which means do, investigate, file charges, against any official, regardless of power and connections. But during four years, SPAK has shown that we are only at the beginning of our work. We hope that the courts will give guilty verdicts on charges brought by us. We definitely have results successful and this is our goal. For the next five years we must believe that we have a consolidated institution with investigations and decisions at all levels. It is difficult, but not impossible, but even these results stimulate and encourage us to work even harder.
But always to have successful accusations, that is, with guilty verdicts. That we have several courts that control us, including Kusht and Strasbourg. In our work as an institution, we also have our problems and our difficulties, which is firstly related to the ambiguity of the status of the Special Prosecutor's Office. You know that the mandate is nine years and after that it is not known where he will end up. I think that this is unfair because the prosecutor should go where he has been and from the top of his career to send the Special Prosecutor to the prosecution offices of ordinary jurisdiction in Shkodër or where my honorable colleagues come from, causes a lack of security.
The biggest damage is institutional and if this troupe for which so much has been invested is very difficult to fill the vacuum. Moreover, there are nine prosecutors who flee at once and this situation has not been resolved, we hope it will be resolved. We have a shortage of legal advisors, because SPAK prosecutors represent the prosecution in all three stages of the trial. Another problem is the vetting of judges and special prosecutors. The head of SPAK takes and represents in KPA all the burden for Vetting. It is nominative. The expectation is about 150 sessions that the leader of SPAK must represent.
There is a 40 percent drop in reports from institutions. Taxes zero reports, customs zero. Is there corruption there or not? Only the KLSH occasionally files reports with the Special Prosecutor's Office, definitely the State Police does..., but the duty of every institution is to fight corruption. To be mindful we all have to do, but we are not the magic wand to control everything. Every institution has whistleblowers, audits, mechanisms and they do not refer.
The other competences of the special court to review the criminal executions of the convicts should be transferred to the special court. Because without wanting to prejudice my colleagues, those who are punished by us cannot be treated as lightly as if they violated traffic rules. The special court should review them, and here I am referring to the release of a former official from another court that happened prematurely" , Dumani said during his speech.
This is not the first case that SPAK prosecutors and judges have been threatened, including the head Altin Dumani.
We recall that, 5 months ago, Dumani asked the forces of order to increase security measures for prosecutor Doloreza Musabelliu, who was allegedly on the list of people that Laert Haxhiu's group would execute. The repentant justice, Artan Tafani, through his testimony revealed the assassination that was being planned against the SPAK prosecutor, Doloreza Musabelliu, by Haxhiu's group.
He showed the plan to 'get rid of' Musabelliu as well as the Lushnja prosecutor Adriatik Doga and also the lawyer Merita Selimi.
