The Special Appeal dismissed today Fredi Beleri's request to be allowed to swear in as the mayor of Himara.
Through a reaction to the media, Beleri says that the Court implemented Prime Minister Rama's order, since he is the supreme judge.
On the other hand, he accuses SPAK prosecutors and judge Irena Gjoka, as they are giving a hand to the attack on the free elections in Himare.
As for the latter, he has filed a complaint with SPAK as Beleri claims that he was not guaranteed a due process of law. On the other hand, he says that he will send the case to the Constitutional Court, as there is the last hope.
Freddie Beller's reaction:
Today, the Court, ordered by the political power, struck once again the elections in Himara. Six months after my request, he implemented the order of the Prime Minister - Supreme Judge, not to give me permission to take the oath and take the mandate.
Without the oath, the mandate is not effective. Without the oath, the constitutional right to elections is violated. It seems that no elections have been held in Himare. With the force of power, in contradiction with the Constitution, and with the lawless blessing of a personal court of the Prime Minister, every principle, constitutional and European norm is being violated in order not to release the Municipality of Himare.
Under the leadership of SPAK's deputy political prosecutor Adnand Xholi, abusing prosecutor Dorina Bejko, and with the cover-up of falsifications in my process by prosecutor Edvin Kondili, this trio completes every order of Prime Minister Rama for the unconstitutional attack on the elections in Himara.
In order to lend a hand to this attack on the free elections in Himare, the President of GjKKO, Irena Gjoka, took care by abusing the relator judge Erjon Çele.
Judge Daniela Shirka gave a "help" today by refusing permission. Contrary to the law and the decision of the Supreme Court, she judged the case as a single judge.
He judges alone that he cannot find two others who humiliate the Constitution and the right to vote in Himara so much. We remind you that some judges who were assigned to my criminal process, resigned because they ultimately did not want to and refused to violate the law and the Constitution of Albania in a flagrant manner.
Two months ago, I filed a complaint with SPAK for judges Irena Gjoka and Erjon Cela and prosecutor Edvin Kondili. They are the only magistrates that I have reported, that with their actions they have ensured that I am not guaranteed due process of law, that falsified acts are administered in my house, that they incite the central government for unconstitutional actions against Himar Municipality, denying the most sacred principle of democracy, governance through free elections.
All our attention is on the Constitutional Court. I have filed several requests there. My appeal against the insurance measure has been pending for three months and there is still no trial date. Rama's pressure remains heavy there as well.
We expect the Constitutional Court to at least protect Democracy, protect the Constitution!
Hope dies last, but day by day, this country's hope is also dying!
