Attorney Genc Gjokutaj, after leaving the Appeal of the Special Court, declared that the rejection of the request of former Prime Minister Sali Berisha to go to the plenary sessions, is in violation of the Constitution.
Gjokutaj said that their request was legitimate and fair, but according to him, justice with direction decided once again against the Constitution. He added that Berisha should be released, as according to him, there is no charge or evidence to keep him in custody.
" The violation of the Constitution was proven, its kicking, from the first instance and the appeal, these eyes that do not look, with direction, these have violated the constitution that Mr. Berisha is not an employee, the cases when the mandate ends or is interrupted, the granting of permission is a partial request, we made it in the name of research without leaving any procedural or constitutional path, I said our research is the release of Mr. Berisha, there is no criminal offense, there is no accusation, there is no evidence, these have put their bodies , this court with its decision. We have not had any kind of response, last time they brought some documents, we have evidence that goes back and forth, SPAK does not accept them, to do a new examination, absolutely nothing ", he said.
