New details have come to light regarding the investigation file of SPAK for the privatization of the former Partizani complex.
In the document made public to the media, the testimony of Commander Vladimir Qirjazi has been disclosed, who shows the communication with the Minister of Defense at that time, Gazment Oketa, who asked him to sign for the transfer of the property, because he himself was given requested.
According to Qirjaz, privatization was required from above.
"I told Minister Gazmend Oketa that I could not sign and he told me that he was also being asked to sign. He told me "It must be signed" but he did not explain to me who had asked him to sign it. Minister Gazmend Oketa told me that this could go to the extent that, in fact, in the report of the audit commission, Minister Oketa requested that I be punished with a disciplinary measure...", Commander Qirjazi said .
In the SPAK file it is stated, among other things, that a photocopy of a letter was found in the Prime Minister, but not the original, dated 30.03.2009, addressed to Sali Berisha, Prime Minister, with the subject "Notification for abuse of official function" signed by the representatives of the owner families Artan Alimehmeti , Ardian Llagami, Kreshnik Kaçurri, Igli Vaqari.
"Although the Archive of the Council of Ministers at the Prime Minister's Office has been searched for, the original letter dated 30.03.2009 addressed to Sali Berisha, Prime Minister, with the subject "Notification for abuse of official function", has not been found", says the SPAK file.
It is also stated in the SPAK file that on Berisha's order, the Anticorruption department exercised control over the Support Command. We remind you that after the departure of Qirjaz, Xhemal Gjunkshi, who completed the privatization procedure, was appointed in his place.

36. With letter No. 1858 Reg. date 02.04.2009, Brigadier General Commander Vladimir Qiriazi, has informed the Chief of General Staff of the Armed Forces, Brigadier General Maksim Malaj, regarding the meetings held with the Minister of Defense Mr. Gazmed Oketa on the issue of handing over the property with No. . 11, where in the content of the letter he clarified that, ... he also informed about other cases that the Ministry of Defense requires the military to sign while it has available the Directorate of Management of Defense Installations and Resources.
In this letter, citizen Vladimir stated that the Minister asked Vladimir to sign as this was also required of him.
He clarifies that he had a meeting with the minister on 31.03.2009 at 18.15 and that he met on 01.04.2009 at around 13.00 with the DMIBM staff, citizens Ardian Shashaj, Roland Llazari and Erinda Ndroqi, Fiqiri Kupe and Besnik Dervishi.
37.1 pyetur përgjatë hetimit shtetasi Vladimir Qiriazi ka deklaruar se: … Unë i thashë Ministrit Gazmend Oketa se nuk mund të firmosja dhe ai më tha se edhe atij po ia kërkonin që të firmosej. Më tha “Duhet firmosur” por nuk më sqaroi se kush ia kishte kërkuar firmosjen. Ministri Gazmend Oketa më tha se kjo gjë mund të shkonte deri në masë se faktikisht në raportin e komisionit të auditit Ministrit Oketa i kërkohej që unë të ndëshkohesha me masë disiplinore….
38.Në Kryeministri, është gjendur një shkresë fotokopje (por jo origjinalja) e datës 30.03.2009, drejtuar z. Sali Berisha, Kryeministër, me lëndë “Njoftim për keqpërdorim funksioni zyrtar” nënshkruar nga përfaqësuesit e familjeve pronare Artan Alimehmeti, Ardian Llagami, Kreshnik Kaçurri, Igli Vaqari.
Megjithëse është kërkuar pranë Arkivës së Këshillit të Ministrave në Kryeministri shkresa origjinale e datës 30.03.2009 drejtuar z. Sali Berisha, Kryeministër, me lëndë “Njoftim për keqpërdorim funksioni zyrtar” nuk është arritur të gjendet. Gjithashtu nga këqyrja e regjistrit të korrespodencës Model Nr.1 në Kryeministri për periudhën 27.03.2009- 02.04.2009 nuk u konstatua as e regjistruar në protokoll hyrje e shkresës/ankesës date 30.03.2009.
39.Nga ana e Kryeministrisë ka patur reagim të menjëhershëm, kur me shkresën nr. 1161 prot datë 03.04.2009 të Sekretarit të Përgjithshëm të Këshillit të Ministrave, shtetasit Gjergj Lezhja, konceptuar nga shtetasi Ilir Kadiu dhe miratuar nga shtetasi Oerd Bylykbashi, drejtuar Komandantit të Forcës Mbështetëse shtetasit Vladimir Qiriazi dhe Sekretarit të Përgjithshëm të Ministrisë së Mbrojtjes, Fiqiri Kupe, është pasqyruar ndër të tjera se, është kryer një denoncim nga familjet Alimehmeti, Vaqarri, Saliaga, Begeja dhe Llagami, aktualisht pronarët ligjorë të truallit të klubit të futbollit Partizani.
40.Ministria e Mbrojtjes gjithashtu ka reaguar duke iu drejtuar me shkresën nr. 2084/2 prot datë 16.04.2009 të Drejtorisë së Menaxhimit të Instalimeve dhe Burimeve të Mbrojtjes, drejtori Ardian Shashaj, Komandes Mbështetëse dhe për dijeni ministrit Gazmend Oketa, sekretarit të përgjithshëm Fiqiri Kupe ku parashtron se Komanda Mbështetëse nuk ka zbatuar urdhërin….
41.Brenda të njëjtës ditë që rezulton se është përgatitur shkresa e mësipërme, duke u njoftuar Ministri i Mbrojtjes Gazmend Oketa, rezulton se ka një reagim të menjëhershëm më datë 16.04.2009 me urdhërin Nr. 1289 Prot, nga Kryeministri Sali Berisha, mbi kontrollin tematik në Ministrinë e Mbrojtjes, mbi zbatimin e procedurave ligjore dhe administrative për dorëzimin dhe nënshkrimin e kontratës së shitjes së pronës me Nr.11, në përgjegjësi administrimi të Ministrisë së Mbrojtjes.
Bashkëlidhur është programi i kontrollit i përgatitur nga drejtor Oerd Bylykbashi dhe i miratuar nga sekretari i përgjithshëm Gjergj Lezhja. Programi i kontrollit është koncept nga Ilir Kadiu.
42. With letter no. prot (illegible) date 24.04.2009 citizen Gjergj Lezhja, General Secretary of the Council of Ministers, has asked citizen Vladimir Qiriazi, to make available to the control group, photocopies, verified with the original, of all the practices related to with the property, within the control, by the department of internal administrative control and anti-corruption.
43. The citizen Ilir Kadiu, turns out to be also a member of the owner families, beneficiaries of the properties located in the Football Club and the Partizani Multisport Club and in an open conflict of interest in the created situation. Moreover, he himself chose the citizen Jamarbër Malltezi as a representative in the relevant procedures regarding the properties.
44. With letter no. 2205/2 regj date 24.04.2009 citizen Vladimir Qiriazi has addressed the Minister of Defense Gazmend Oketa, where he informs that in implementation of the control order of the Prime Minister, Sali Berisha, no. 1289 dated 16.04.2009, on 24.04.2009 the citizens Ilir Kadiu and Saimir Struga appeared in the Support Command to exercise control. It continues with the submissions that this property was not taken over by the Support Command, there was no representative in the proceedings.
