Lawyer Edmond Petraj spoke about the arrest of Mayor Erion Veliaj. He said that Veliaj should not just stick to public statements, but should also file criminal charges against Prosecutor Olsi Dado for any allegations he has, along with his group of lawyers.
"Erion Veliaj should file a report if he has allegations. If there was a conflict of interest, Dado would have withdrawn, he would have evaluated it. If what Veliaj says about Dado is true, he should file a report through lawyers. If there is a conflict of interest, they should make the request to Altin Dumani, but they must be convincing. Otherwise, he should bear responsibility himself ," he says.
While also pointing out the favoritism that the law seems to have shown him in his career, the lawyer states that so far there is no fact that proves the opposite.
"Dado graduated from the Faculty of Law in 1991. He inherited the notary's license from his father. In 2008 he became a prosecutor in Pogradec, this is where the problem lies, I don't think the law at that time wanted the Magistrate and the 3-year process, which required him to be a lawyer or work in other institutions. In my opinion, this does not prevent him. The laws of the time favored Dado becoming a prosecutor. The problem remains: if you have evidence and allegations, go and file a report," the lawyer said.
Petraj is against the way Veliaj was arrested in the office and also against the coercive measure, as the Municipality has been left without a mayor.
"This drastic security measure could not have been taken. If SPAK had thought about this deeply, it would have separated the case, because it concerns the Municipality of Tirana, which has been left without a leader. But it remains in the hands of the prosecutor how he justified it and along the way it is expected to be clarified from 365 pages to over 800 pages, where it was based, how it was argued, how it was given and found, the claims of the lawyers will be added. So that court decision will be remade, according to the procedure. The property investigation should have been done later, after a financial and legal analysis. Because the Prosecution says 800 thousand euros, while Xoxa says 75 thousand euros, a financial analysis of the actions will be done. This has not been done. The property investigation does not stand at this point of the investigation. The court decision does not mention intimidation by Veliaj, who did this, went there, etc. But it is said that it could damage the evidence. "But he could have been left as a suspect, if he hadn't been arrested," he explains, criticizing the procedure that was followed.
For Petraj, the restrictive measures of detention are excessive in such cases, but he emphasized that the responsibility falls entirely on Olsi Dado and he is the one who must justify every subsequent action.
"They have introduced the measure of arrest with imprisonment into the system and I don't like it. But it remains with the prosecutors, he has special authority, the responsibility falls on Olsi Dado, every responsibility falls on him. The pronouncement seems to be fading, he should deal with the evidence, the elements. The responsibility for the Veliaj file falls on Olsi Dado. The Mayor should have carefully considered the security measure, he should not have been arrested in the office. I don't know who Veliaj's lawyers are, they have never appeared at a conference or in the media, we only have his reactions from the cell ," the lawyer concluded.
