The National Chamber of Advocates has decided to boycott court hearings and criminal trials, as a sign of revolt over the arrest of lawyer Ulian Barjami.

The lawyer was arrested for flagrant misconduct, simply because he opposed the prosecutor in a court hearing. The latter, supported by the judge of the hearing, retaliated by suing him and then went to the final act of arresting the lawyer.

The Chamber of Advocates has decided to boycott all hearings until October 25, at all levels of the judiciary.

" The Steering Committee of the Albanian Bar Association reviewed the extremely serious event related to the arrest of colleague Av. Uljan Barjamaj, after personally informing colleague Barjamaj and the steps taken in detail regarding this event. With a circular decision, the Committee unanimously decided: Blocking, through boycott, all criminal proceedings, both in investigation and trial, at all levels, including proceedings in the Constitutional Court, for the dates October 20 to October 25. The effects of this decision are excluded from participation in criminal hearings with the purpose of assigning, notifying, replacing and granting reductions in security measures ," the decision states.

Lawyer Barjami, during the court session for the assignment of security measures against his client Maksim Lika, said that he would personally deal with the prosecutor and judicial police officers, filing criminal charges against them for what he considers to be the manipulation of evidence against his client.

From this moment, also referring to a video published by lawyer Arben Llangozi, there is an extreme reaction from prosecutor Gjergji Ceka who is heard saying that 'the lawyer should be arrested'.

Then there is a harsh reaction from the judge, who, referring to the audio from the court session, warns the lawyer several times, interpreting the lawyer's statement on the same wavelength as the prosecutor, thus considering it a threat.

From what has been published, it appears that a trap was set for lawyer Barjami in the courtroom, when at the moment he announces the criminal complaint, the prosecutor announces the arrest and the judge keeps up the 'game' of considering the lawyer's words as a 'threat'.

Decision of the Chamber of Advocates

The Steering Committee of the Albanian Bar Association reviewed the extremely serious incident regarding the arrest of colleague Av. Uljan Barjamaj, after personally informing colleague Barjamaj and the steps taken in detail regarding this incident. By circular decision, the Committee unanimously decided:

1. Blocking, through boycott, all criminal proceedings, both in investigation and trial, at all levels, including proceedings in the Constitutional Court, for the dates October 20 to October 25. The effects of this decision are excluded from participation in criminal hearings with the purpose of assigning, notifying, replacing and granting reductions in security measures.

2. Failure to represent lawyers in criminal proceedings, both during the investigation and trial on the above dates, as well as for purposes of reviewing court proceedings.

3. Failure to implement this decision by lawyers constitutes a serious disciplinary violation, which is considered as a basis for initiating a disciplinary investigation by the Disciplinary Committee, accompanied by the measure of expulsion by disciplinary decision, up to and including the revocation of the license to practice the profession.

4. The Steering Committee requests urgent and responsible engagement in reviewing this issue by the High Inspector of Justice, the High Judicial Council and the High Prosecutorial Council.

5. The Local Bar Associations are responsible for the implementation of this decision.

6. Depositing a copy of the decision with every court at all levels.

8. Postponement to another date of the roundtable previously scheduled with the Ministry of Justice on October 20, with the subject of "Discussion of the Draft Criminal Code between the working group and the Albanian Bar Association, organized by the Ministry of Justice.
