After the Parliament's approval, SPAK sent the request to GJKKO, which will decide the measure for the former prime minister in Tuesday's session.

In his analysis, the researcher and academician Artan Fuga said that Sali Berisha must now defend himself and prove that he is innocent.

While for the opposition itself, there is a big task to determine what will be done with him if this arrest happens.

" I generally and from my philosophical beliefs do not consider anything impossible. And for the possible events that will follow, anything is possible.

In the capacity of a researcher of the transition in these 30 years, with the arrest of Mr. Berisha closes a political cycle, as we have a President, Prime Minister, oppositionist, and finally there comes a moment when he has declared himself and his arrest is expected to be announced by the court. so, it is a closing of his personal cycle and I have always said that unfortunately Albania, for all its well-known figures in these 110 years, has known the same cycle.

So now it's a cycle within the Democratic Party, which of course is expected now despite being in front of a warm wound, but it will cool down and see that it is in front of a big uphill, in front of a very delicate and difficult phase. This party, which in 30 years has given its voice either in government or in the opposition, now with the isolation that is expected to be announced by the Court, a very - very difficult phase opens before it.

I cannot replace the prosecutors in my trials, nor the Constitutional Court, but when it comes to the part "should or should not the consent of the Assembly be obtained to limit the freedoms of Mr. Berisha", was this an infringement of liberties or freedom, because the Constitution talks about "Freedom" and not about "liberties" which for a person who does not deal with this work seem unimportant, but a word in legal logic plays an extraordinary weight and the interpretation of this, whether this request is in accordance with the Constitution, this remains a very controversial issue.

I want to tell you something that I have not heard, but that I have thought to myself, I say that the Constitutional Court certainly has in its task to see whether a law, a decision, a behavior is in accordance with or not the constitution. But is the Constitution consistent with the Constitution? This is not a matter of the Constitutional Court, but only a matter of the Assembly. Because the Court cannot give a judgment as to whether the Constitution, which was sealed at the end by the Assembly, has been properly interpreted or not when talking about "removal of freedoms" or "restriction of freedom", no other body can do this, whether this or the Court Constitutional, when the Assembly that voted this Constitution is convened. And this, for me, belongs to the Assembly.

Of course, I think that in this case not only the group of MPs who filed the complaint in the Constitutional Court has had an interest, but all the MPs have had an interest.

Albania is a very small country and is in its very first steps for the democratization of the country, and in Albania the separation of powers of the Legislature and the Judiciary is in a very fragile state.

The Constitutional Court, its members, and all prosecutors and judges are still under great political pressure, so an Albanian MP needs to be protected by the MP's immunity, except in flagrant cases. I am convinced that in the conditions we are in, we do not have the luxury of having MPs without immunity. Because strong evidence is required which I have not yet seen and I do not say that Mr. Berisha is neither guilty nor innocent, but I am saying that the Albanian MPs need a defense, for evidence, for procedures, for a debate, for a discussion in the Assembly, that is, for a respect for an elected representative of the people.

Because such an accusation of corruption, and as far as I know against an opposition deputy, of course this accusation also has its political dimension. Because in this case the head of the Opposition is hit, and with him the entire Opposition is hit.

Now for me this is of little importance, but it is known that the head of the Opposition in these 30 years has been the object of political attacks, since Fatos Nano, Sali Berisha, even Edi Rama, and Ilir Meta. But for me the problem is not this, the problem is the phase that comes, where Mr. Berisha should definitely be investigated and Mr. Berisha must now prove that he is innocent.

Meanwhile, from a political point of view, the Democratic Party is facing an uphill battle, because the question is: "What will be done when its leader is politically isolated?"

They know the answer to that, how good they will be, as all possibilities and risks are open. This in the sense that these 40-43 MPs who in recent months had shown some kind of cohesion in their attitudes, despite the extraordinary differences with their attitudes, but who were trying to live together, will they live together anymore? Will they be together again? Will they agree to cooperate anymore?

Secondly, the next moment comes that has to do with the fact that how the Democratic Party will be run concretely. I see this as unclear. The slogan "To wake up the lion", i.e. "to wake up the people" is I don't know. Because it seems to us that we are in the Enlightenment period, where the people are waiting to be enlightened and then they will rise. No! People are clear, they did the math themselves.

I don't think that now is the moment for concrete people who can succeed Mr. Berisha, or that this can be done by individuals. I have been saying for months that the opposition, preserving this tradition, respecting those who have made contributions, respecting all those who have a large electoral capital, should bring out a group of young people aged 40-45 with new ideas. , new profiles, not consumed in public, to be a group of young people with new emancipation, in order to give hope to the electorate for an opposition that not only criticizes corruption, but gives the alternative that is missing today.

So, I think the only solution for the Democratic Party is to put out a group, let's call it a possible shadow government. Biles, not one, but two or three or 40 talented young people, who will have the opportunity to lead tomorrow ", said academic Artan Fuga in his analysis in "Ora News".
