KLSH sinks Arben Gjata, how is it possible that he is both a full-time lecturer and Rector?
The High State Control has discovered a multitude of abuses at the University of Medicine headed by Arben Gjata. In December of the last year, the HLSH conducted an audit and it seems that this University has abused funds, fuel, employment, in short, everything.
The " Pamphlet " is making a summary of the findings of the HCSC today, while in the following days we will go into more detail.
According to KLSH, UMT, for study program fees, has not carried out a methodology for their calculation until September 2023. The fees applied by UMT are based on a reference regarding the hypothetical expenses of the coherent year, taking as a basis previous year's expenses. According to KLSH, it results in non-compliance with the specific legislation for higher education. Institutions of higher education in Albania develop/conduct their activities in accordance with the specific law no. 80/2015 "On higher education and scientific research in institutions of higher education in RSH" and the by-laws in force. his.
It is further stated that the University of Medicine, Tirana, has had and continues to have a marked lack of academic staff. According to the report, the Rector is employed full-time, in the position of lecturer in the Department of Surgery, Faculty of Medicine, University of Medicine, Tirana. According to the auditors, the Rector is the administrative staff of the Rectorate of the University of Medicine, Tirana and not the academic staff as shown in the list of payments and the attendance list of the FM of the University of Medicine Tirana.
" From the audit of the attendance list in the respective salary files for the Faculty of Medicine and for the administrative staff of the Rectorate of the University of Medicine in Tirana, for the audited period, it was found that in the attendance lists of the Rectorate staff, it was presented as present at work with full-time schedule Rector. There is no physical possibility for the Rector, part of the administrative staff of the Medical University of Tirana, in the position as head of the public HEI, to be present in his duties assigned by law according to the appointment position, at the same time that he is engaged full-time in teaching in the relevant department of the faculty. The law on higher education assigns the Rector to perform the tasks in the function of the good administration of the institution of UMT. In reality, the rector performs the duties of a pedagogue and not the duties assigned to him by law. From what was determined by the audit group, it results that the Governing Authorities of Tirana University of Medicine are paid for secondary functions and not for primary functions, while the law has charged them with the fulfillment of duties in primary functions, this also for the very importance at the national level that there is the University of Medicine in Albania, which obliges a full-time management level according to the requirements of the law ", says KLSH.
According to the report, the engagement of the Administrative Management Staff of UMT, in teaching, full time, in the judgment of the audit group has created/may have created consequences in the good administration of the duties that the law assigns to these positions.
Further, KLSH states that the lecturers contracted late by the Rectorate, are legally proven to have taught lessons and to have completed the respective evaluations for the teaching hours developed, without having previously had an employment contract with the Medical University of Tirana. External pedagogues, contracted by UMT, performed the work of the lecturer and at the same time certified the students for the teaching subjects given to them, without having a legal employment relationship.
" The use of income is unfulfilled, the income from 2019 to 2020 in the amount of 711,593,504 ALL, from 2020 to 2021 in the amount of 704,162,196 ALL and from 2021 to 2022 in the amount of 802,513,792 ALL, while in the law no. 80/2015, article 118 "Independent public institutions of higher education", in point 5, it is determined that: "IALPPs do not aim at profit and the income obtained from their activity and assets are used to achieve the mission of the institution" ", continues KLSH.
Also, KLSH found economic damage in one case in the amount of 513,552 ALL as well as ineffective use of funds in three cases in the amount of 35,145,120 ALL, which we will talk about below. / Pamphlet
