
Lawyer Spartak Ngjela has spoken about the postponement of the session for January 21 by the Supreme Court.
Njjela said that the decision given to the two guards who were sentenced to 1 and 3 years in prison after shooting at the protesters will be reviewed.
According to him, the judges who gave this decision to the guards Ndrea Prendi and Agim Llupo, are at risk, since such a decision can only be given by the corrupt or incompetent.
"In the beginning, it was a trial completely outside the normal procedural concept, not all the defendants were taken, now the high circles are taken as defendants. This has restarted to give in justice and has taken big personalities, even the minister as a defendant. It is an improvement on the first abuse. If the court sentences and passes it in very justified spheres with facts, the judges of the first sentence are endangered. Even the accusers of the first sentence. Because it is understood that they are either corrupt or incompetent. Because it is a violation of the law. They are called absolutely invalid decisions", said Ngjela.
Regarding the question of whether Berisha can also be taken as a defendant for January 21, the lawyer said that the former prime minister is far from criminal responsibility.
He justifies this with the fact that the government's decisions are collegial and no personal responsibility is held.
"The prosecution should have found him, not me. He has accusations. Speaking a priori, he is far from criminal responsibility because a government decision has a provision, for collective crimes there can be no personal responsibility. The government's decisions therefore escape them because they are collective decisions despite the fact that the prime minister signs them", said Ngjela speaking to Report TV.
