Lawyer Kreshnik Spahiu has commented from a legal point of view on the granting of the security measure "Compulsory appearance" for former Prime Minister Berisha.
Invited to Euronews Albania, Spahiu said that Berisha is now under investigation for the charge of "Abuse of duty" and a criminal investigation will follow.
The lawyer added that SPAK with the given security measures has proven that the entrepreneur Fatmir Bektashi, Jamarbër Malltezi, already arrested, and former Prime Minister Sali Berisha are responsible for the privatization of the former Partizani complex.
According to him, SPAK had a "free hand" to issue the security measure "Arrest with prison" for Malltez and Bektash since they do not enjoy immunity. He emphasized that if the security measure "Arrest with prison" were to be given to Berisha, approval from the parliament would be required.
"For the public's knowledge, we have 3 defendants in this criminal case. SPAK has requested to take three subjects as defendants, the former prime minister Sali Berisha, his son-in-law Jamarbër Malltezi and the entrepreneur of the company Fatmir Bektashi. We have three subjects under investigation but with different coercive measures. Coercive measures are taken in advance by the prosecution to guarantee a thorough and impartial investigation. We have two extreme measures of "imprisonment", for the entrepreneur Bektashi, for the son-in-law of the former prime minister Malltezi, while for Sali Berisha we have a lighter measure. "Compulsion to appear" is the easiest measure for someone involved in a criminal case. The accusations made public are "Money Laundering" for Jamarbër Malltez and Fatmir Bektashi, while Berisha is accused of "Abuse of duty" and "Money Laundering".
Malltezi and Bekteshi did not have immunity and therefore the prosecution saw a free hand. In the event that SPAK would request the arrest of Berisha, then SPAK would have to obtain the approval of the parliament", said Spahiu.
