
Among the evidence in the hands of SPAK is in fact the minutes of the meeting of the Council of Ministers held on 18.06.2008, in which the fate of the Partizani sports complex is also discussed, and Berisha, who leads the meeting, has no doubt: It must be given to the owners.
It is not true what Sali Berisha and his family claim that when he was prime minister, the father-in-law of Jamarber Malltez never personally dealt with the procedure of privatizing the former Partizani complex in the interest of the son-in-law. Among the evidence in the hands of SPAK is in fact the minutes of the meeting of the Council of Ministers held on 18.06.2008, in which the fate of the Partizani sports complex is also discussed, and Berisha, who leads the meeting, has no doubt: It must be given to the owners.
The topic of that meeting was the approval of an urgent change to Article 31 of the Law on Sports to give the owners of the land of sports facilities the right to privatize the facilities, allowing the change of destination: "Sports facilities are privatized by the owners of the land, when there are any, otherwise they are granted with a concession provided that the destination does not change" was the text of the amendment to be approved.
Exactly the amendment that Jamarbër Malltez and the other owners needed, who according to the law in force until that moment, would not have been able to privatize the Partizani Complex to build the 19 towers they had planned on it, but would only receive as a concession while maintaining the existing sports facilities.
In fact, 8 months before this amendment, the Minister of Sports Ylli Pango had proposed and approved another amendment (which had obviously escaped Berisha's control) and which provided for sports facilities only the possibility of giving them a concession, but without changing the destination. An amendment that made it impossible to realize the real estate project of Jamarber Malltez and Fatmir Bektashi over the land of the Partizani sports club. This is the reason why on June 18, 2008, the corrected text supported by Sali Berisha, returned to the Council of Ministers, and for this SPAK considers the minutes of that session one of the proofs of his corruption.
All the more so that the determination and anger with which the prime minister supports that new correction of the sports law was also a clear order heard by all the ministers present at the board meeting not to hinder in any way the privatization project of his son-in-law for the Partizan Sports Complex
The government meeting took place in June 2008 when Jamarber Malltezi had already signed the agreement with the builder Fatmir Bektashi for participation in the construction of the towers as an investor and not simply as the owner of a small plot of 400 square meters, as he has claimed for a Berisha family for a long time. "Jamarber was a minimal beneficiary of the privatization process as it was only one of the hundreds of owners," the Berisha family repeated as an alibi.
In fact, at the end of the whole process, Jamarber Mallltezi (who bought at least another 2150 meters of land from the former owners who, due to the law and the situation on the ground - as admitted by Argita Berisha - consider it impossible to privatize the Complex) will be the owner of almost 50% of the entire investment, earning almost 6 million euros according to SPAK. An impossible gain if Berisha and his government had not modified the legal framework to achieve the return of the lands and the privatization of the Partizani complex, including the possibility of building on it.
When on the morning of 18.06.2008 he chaired that meeting of the Council of Ministers, Sali Berisha could not have been unaware of his son-in-law's real estate project on the Kompleski Partizani plot, since every morning and every evening, as Argita Berisha recently told Adi Krasta on the family television, Saliu calls the whole family to discuss common problems, with a discipline that she herself defined as "almost military". And it is precisely with military tones that Sali Berisha directs that meeting of the Council of Ministers during which he openly issues his order for the privatization of the land of the Partizani complex, adding that he is ready to eliminate the other stadiums from the city in order to return their lands all former owners.
The minutes of that government meeting clearly refute for the first time two statements with which Sali Berisha tried to distance himself from what he clearly understood as a compromising government act. Immediately after the arrest of the groom, Berisha said that SPAK had manipulated the interpretation and that this amendment to Article 31 of the Sports Law confirmed the obligation for owners to respect the sports use of facilities. In July 2008, when he voted for the amendment during the public session in the Parliament, Berisha debated with the socialist MP Erjon Braçe, who argued that with that wording he would open the destruction of all sports facilities, including Partizani Club. And Berisha had a different attitude from what he has presented now:
Braçe: Pra kushtin që të mos ndryshojë destinacioni ju e futni në këtë nen vetëm për shoqëritë aksionere apo për klubet, dhe mirë bëni. Por ç’ndodh në rastin kur ka ish-pronarë? E mori pronën pronari, shumë mirë, ia dhatë këtë të drejtë, por pse nuk vendosni kushtin, që normalisht kjo pronë të mos tjetërsohet? Prandaj, zoti Kryeministër, thashë pak më parë që ky nen nuk ka lidhje me sportin. Ky nen ka lidhje me trojet dhe ky është një problem shumë i madh.
Kryeministri Sali Berisha: Do të përgjigjem në mënyrë shumë të thjeshtë. Se çfarë do të bëjnë pronarët, të jesh i bindur që Qeveria ka zero tagër në Tiranë. Qeveria e Tiranës jeni ju dhe është kryetari i Bashkisë së Tiranës. Të nderuar zotërinj, se çfarë do të bëjnë pronarët me territorin e tyre, e ka në dorë Bashkia e Tiranës dhe pronari, jo Qeveria. Në fakt, ju e keni shënjestrën tjetërkund, jo tek unë. Është puna juaj.
Një qëndrim prap krejtësisht i ndryshëm nga ai që Sali Berisha kishte shprehur vetëm pak ditë më parë në sekretin e mbledhjes së Këshillit të ministrave:
Sali Berisha: Kur ka pronarë sigurisht që privatizohet (...) Po t'i them unë pronarit se do ta mbash ti këtë për sport, unë them para teje. Këtë i them, po se çfarë bën ai, atëherë nuk më intereson më.
Ekrem Spahia: Nëse do kemi procedurat e sakta, besoj se edhe këto terrene sportive asgjësohen. Kam parasysh që disa gjëra, ambientet përtej stadiumit ose përballë stadiumit Selman Stërmasi, mbrapa stadiumit Qemal Stafa, Klubit Partizani dhe klubit Dinamo.
Sali Berisha: Që të gjitha t'i marrin pronarët. Nuk ekzistojnë më stadiume brenda qyteteve si në Tiranë!
U deshën 16 vjet dhe hetimi i SPAK-ut, por të paktën në këtë pasazh të historisë Partizani tashmë është bërë e qartë: Sali Berisha jo vetëm ishte i përfshirë personalisht, por ishte plotësisht dakord që në vend të objekteve sportive pronarët e tokave mund të ndërtonin pallate. Sidomos të dhëndrit të tij. Pavarësisht nga mundësitë e sigurura nga Ligji për Sportet, kur tashme kishin fituar zgjedhjet e majit 2011, destinacioni i përdorimit të atyre terreneve sportive u modifikua përfundimisht edhe nga Bashkia dhe nga KRRTRSH. Por jo kur ishte kryetar bashkie Edi Rama siç pretendojnë Saliu dhe Abi, por në 2013 kur ishte kryebashkiak Lulzim Basha.

The way for the construction of 19 towers instead of sports fields, running tracks, gymnasiums and swimming pools was finally opened through the amendment of the Law on Sports. The legal changes were signed by Sali Berisha. The consultant for the regulatory plan for the Municipality of Tirana headed by Lulzim Basha, who paved the way for the colossal investment, was the investor Jamarbër Malltezi himself.
