The High Judicial Council has accepted in today's hearing, the request of the High Inspector of Justice for the dismissal of the judge of Elbasan, Zamira Vyshka.
Zamira Vyshka was found guilty by the Special Court, which sentenced her to 2 years in prison for the criminal offense of corruption, but due to the shortened trial, she was put on probation.
The High Judicial Council has accepted in today's hearing, the High Inspector of Justice's request for disciplinary proceedings with the measure 'Dismissal' for the magistrate ZV, judge at the Court of First Instance of Elbasan General Jurisdiction.
"ILD has initiated the disciplinary investigation against the magistrate ZV, with the duty of judge at the Elbasan Judicial District Court, for the disciplinary violation provided for by article 140, point 2, letter "b" of the Constitution of the Republic of Albania, as well as by article 104 of law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania", amended, due to the punishment for committing the criminal offense of "Passive corruption of the judge, prosecutor, and other officials of the justice bodies", provided by Article 319/ch of the Criminal Code.
The disciplinary investigation carried out by ILD inspectors concluded that the judge was found guilty and was sentenced by the Special Court of First Instance and the Court of Appeal for Corruption and Organized Crime, for committing the criminal offense "Passive corruption of judges, prosecutors and other officials of the justice bodies", provided by article 319/ç of the Criminal Code.
The irregular exercise of duty by the magistrate, even for the very nature of the criminal fact committed, constitutes a very serious disciplinary violation, which has brought consequences for the delivery of justice, has seriously discredited the image, authority, dignity and has been seriously damaged public trust in the magistrate and in the justice bodies.
The inspectors of the ILD requested the appointment of the disciplinary measure "Dismissal from duty", a request that was accepted by the High Judicial Council" , it is stated in the announcement of the HCJ.
