Attacks on judges, KLGJ: Image and dignity are being violated, pressure on the

The Constitutional Court has reacted through a statement about what it considers to be increasing pressure on judges and the judiciary. The reaction of the Constitutional Court comes after several statements by Prime Minister Edi Rama towards judges and prosecutors, especially towards two associations that have addressed the Constitutional Court and are demanding an increase in salaries for the justice system. But also reactions from the opposition towards the member of the Constitutional Court, Irena Gjoka, who according to official documents is convicted in Greece and has not declared this in the decriminalization form, which puts the continuation of her career in the judiciary at risk.

"You are not a political party, to give such opinions in public, you are a judge. How can you throw mud at the government of this republic with this kind of rhetoric?! And moreover you talk about fictitious deductions of the reference salary made by the Council of Ministers.

"And you say that we have worsened your financial position. These are lies, produce a document of financial deterioration because you are not a political party to make public statements, make them when you really have comments when your position is being violated," Rama declared a few days ago, in a clash he had with judges and prosecutors.

But the High Judicial Council, in its reaction, expresses itself against positions that harm the image and dignity of judges, as well as undermine the independence of the judiciary.

The Supreme Court of Justice emphasizes that in every democratic society, judges are guarantors of the equality of parties before the law. "Consequently, the exercise of their function must be independent and free from any form of influence, subject only to the Constitution and the laws," the statement says.

In addition, the High Judicial Council expresses its understanding of the critical positions and opinions expressed by public officials or private entities, and in particular by the written and audiovisual media, which contribute to increasing the transparency and effectiveness of the judicial system.

" But recently, there has been a worrying "pressure" on judges and the judiciary, which has an increasing tendency, as well as the emergence of some positions or statements with a visible impact on informing public opinion, which, in addition to violating the human rights of judges due to the exercise of their duties, also seriously endanger the performance of their legal functions."

The High Judicial Council reiterates that such positions harm the image and dignity of judges, as well as undermine the independence of the judiciary. The High Council, in compliance with its constitutional duty, is in defense of the integrity of judges and the judicial system and calls on them to avoid such statements, which attempt to influence the judicial system.

The High Judicial Council brings to the attention of public opinion that it respects the irreplaceable mission of the media to inform the public about the activities of the judicial system, but on the other hand expects the media to respect the dignity of the court and the judge, by not transmitting information that contains offensive language or images that harm the image of the judge.

The Council calls on all public and private entities to respect the independence of the judiciary as one of the foundations of the rule of law. The only way to challenge a judicial decision is through the procedural means provided by law, by appealing to a higher court.

Likewise, any complaint or allegation regarding the conduct or integrity of a judge should be directed to the relevant institutions ," the statement made public by the Supreme Court of Kosovo states.
