The Special Appeal has upheld the decision to sentence the former head of the Constitutional Court, Bashkim Dedja, to 6 months in prison.
The appeal of GJKKO has upheld the decision of the Special Court of First Instance for Corruption and Organized Crime for the former head of the Constitutional Court Bashkim Dedja.
SPAK had requested 1 year in prison for the former head of the Constitutional Court under the charge of concealment of wealth, but the GJKKO sentenced him to probation.
According to the Prosecutor's Office, the former number one of the Constitution, has hidden in the statements an apartment located in the "Ormars" complex in Golem.
He also made a false declaration of the source of the creation of the apartment in Tirana with an area of 146 m2, related to a loan taken from his brother-in-law. For 10 thousand euros borrowed from Bashkim Dedja according to SPAK, they are not justified by the person who gave it to them.
The accusations were dismissed before by the former head of SPAK who stated that he received the loan of 10 thousand euros from his brother-in-law, who worked in emigration and did not declare the income from emigration.
Meanwhile, regarding the apartment in Tirana, Dedja stated that he had taken it with a loan, which he will still have to pay.
"As for the loan of 10 thousand euros, it belongs to my brother-in-law and he worked in emigration and the income from emigration is declared. As for the apartment in Tirana, I got a loan for it, and I will pay it until 2023", said Deda.

The Special Court of Appeal for Corruption and Organized Crime, with a panel composed of judges Saida Dollani (presiding), Nertina Kosova (member) and Miliana Muça (member), today on 13.02.2024, announced the decision regarding the case of registered with no. 6/63 act, date 06.12.2023 registration, on the appeal presented by the appellant/defendant Bashkim Dedja, against decision no. 43, dated 26.06.2023 of the Special Court of First Instance for Corruption and Organized Crime, which decided:
1. The guilty plea of the defendant Bashkim Dedja, for committing the criminal offense "Refusal to declare, non-declaration, concealment or false declaration of assets, private interests of elected persons and public servants or of any other person who has the legal obligation to declare ”, provided by article 257/a, second paragraph of the Penal Code and based on this provision, his sentence with 6 (six) months of imprisonment.
2. In application of Article 59 of the Criminal Code, the suspension of the execution of the sentence of imprisonment for the defendant BD, for a period of 1 (one) year, provided that during the probation period the defendant maintains contact with the probation service of his place of residence, as well as not to commit another criminal offense.
3. In support of articles 393 and 485/3 of the Criminal Code, court costs according to the attached form must be paid by the defendant...
In conclusion, the Special Court of Appeal for Corruption and Organized Crime decided:
Enforcing decision no. 43, dated 26.06.2023 of the First Instance Special Court for Corruption and Organized Crime.
