The Municipality of Himara has announced a tender worth around 300 million lek including VAT for the "purchase of a financial management system", a procedure that from the start has raised strong questions about the way it was built.

From the verification that skyweb.al made of the tender documents yesterday morning, it results that the technical criteria are in some cases exaggerated and unclear, suggesting artificial inflating of the fund and limiting competition. Elements such as the request for access for hundreds of users or the lack of concrete technical parameters make this tender difficult to bid on in a realistic manner.

Following these findings from the editorial staff, Skyweb.al addressed the Himara Municipality with a request for information, seeking details on the practice followed and the number of people who will use this system. In relation to another request for information a few weeks ago, the Himara Municipality continues to violate the law, even permitted by an institution such as the Commissioner for the Right to Information.

Meanwhile, just a few hours later, yesterday afternoon, three well-known companies in the digital services sector filed complaints with the Public Procurement Commission, confirming the problems identified with this tender, which from previous experiences seems to have many problems, if not canceled.

According to them, the tender was drafted with serious legal and technical shortcomings, indicating a lack of knowledge of procedures or a tendency to limit competition and orient the outcome.

Specifically, the companies DataLog, Kreatx and Smart ICT Services have been addressed at the CPC.

All three, with different approaches, request a deep review of the technical criteria, while one of them goes even further, requesting the complete cancellation of the procedure and its re-announcement from scratch due to the errors of the Himara Municipality.

What are the companies that appealed the tender demanding?

DATALOG sh.pk directly opposes the criteria set out in the tender documents, describing them as inflated and not in accordance with the law.

It calls for the removal of the obligation for 3-month payrolls and the reduction of the requirements for years of staff experience, which it claims exclude other operators from the competition. It also opposes the limitation to only "cloud" solutions, demanding that other technical alternatives be allowed.

The company also highlights a lack of clarity in documents and the use of outdated legal references. Essentially, it calls for a review of the criteria to guarantee real competition and equal treatment for operators.

On the other hand, KREATX sh.pk, maintains a stronger stance, demanding the complete cancellation of the tender and its re-announcement from scratch.

According to her, the documents are incomplete and incorrectly constructed, starting from the classification of the contract as a "goods" and not a "service".

It objects to the scoring method and the criteria for staff, stressing that they are unclear and leave room for interpretation. It also points out the lack of basic technical elements that would allow for real bidding. For KREATX, the procedure does not guarantee transparency and competition and should be restarted from scratch.

Meanwhile, Smart ICT Services focuses its complaint on the technical shortcomings of the tender, arguing that the specifications are incomplete and insufficient for building a real offer.

According to her, the request for data migration, integration with state systems and advanced functions was made without providing basic parameters such as volumes, structures and method of implementation.

There is also a lack of data on the number of users and system load, which makes it impossible to calculate costs.

Smart ICT demands a complete review of the technical specifications, emphasizing that this form of tender favors certain operators who may have inside information and undermines competition. / Skyweb.al
