Sali Berisha's lawyer, Genc Gjokutaj, has appealed the Special Court's decision against Sali Berisha, who has been placed under 'obligation to appear' and is not allowed to travel abroad.
On October 26, the Special Court confirmed the mandatory presentation measure and blocking the use of the passport for former Prime Minister Sali Berisha.
According to the decision, Berisha must appear in court on the first and third Monday of every month, at 10:00.
However, he has refused to appear in court, with the argument that he cannot violate the Constitution, referring to the immunity he has as a deputy of Albania.
The former prime minister is suspected of the criminal offense "Passive corruption of high state officials or local elected officials", committed in collaboration.
According to SPAK's voluminous file, Berisha favored his son-in-law, Jamarbër Malltezi, for the privatization of the former Partizani Sports Complex.
Meanwhile, three days ago, the Special Court of First Instance for Corruption and Organized Crime upheld the "prison arrest" measure for Jamarbër Malltez and the "compulsion to appear" measure for the builder Fatmir Bektashi.
Malltezi, through the investment in the company "Homeplan shpk", which carried out the constructions at the former sports complex "Partizani", has benefited 5.4 million euros, which according to the Special Anticorruption Prosecutor's Office is illegal money since he was not an investor, thus hiding the origin of the money. He used the builder Bektashi to launder this money.
