The families of demonstrators killed by security forces in an anti-government protest in 2011 have renewed hopes for justice after the Supreme Court transferred the case to SPAK.
It was the first demonstration to result in the killing of protesters since the end of Albania's repressive communist regime, and has long been seen as a test for the country's justice system — a test it has so far failed.
On January 21, 2011, Edi Rama, at that time the head of the opposition Socialist Party, led a demonstration against the government of the time, led by the Democratic Party politician Sali Berisha, in front of the prime minister's office on Dëshmorët e Kombit Boulevard in Tirana.
The protest was called by the Socialist Party after a video emerged implicating then-Foreign Minister Ilir Meta in corrupt activities - showing him discussing how to profit from a public tender.
During the protest, violence broke out, while the protesters clashed with the police and four protesters - Ziver Veizi, Faik Myrtaj, Hekuran Deda and Aleks Nika - were shot by the Republic Guard. Several others were injured by gunfire.
Two years later, the commander of the Republic Guard and a guard were convicted of negligence in the deaths of Veiz and Myrtaj, but not of their murder.
However, the deaths of Deda and Nika controversially went unpunished and remain so to this day. But now there is a glimmer of hope for the families.
In September 2023, Nika's relatives filed a criminal complaint accusing former Prime Minister Berisha, former Interior Minister Lulzim Basha and former Commander of the Republic Guard Ndrea Prendi of ordering the shooting of the protesters.
A development last month then gave them new hope. On March 12, the Supreme Court of Albania decided to order the Special Prosecution Against Corruption and Organized Crime, SPAK, to take over the criminal proceedings. SPAK is an independent judicial entity that is responsible for the investigation and prosecution of the highest level crimes in Albania.
The Supreme Court's decision to transfer the case to SPAK comes after the European Court of Human Rights, ECtHR, found in November 2023 that the unfinished investigations had violated the victims' right to life.
The ECtHR also found that the investigations had been obstructed by the government of the time, and specifically by Prime Minister Sali Berisha, and demanded that the investigation include the commanders of the Republic Guard, not just the officers who opened fire.
Rigels Xhemollari, an education and youth expert from the Tirana-based Qendresa Cittare, said he believes that SPAK taking over the case means there will be "a better, more comprehensive and adequate investigation".

“Prokurorë pa shtyllë kurrizore”
Pas vdekjeve në vitin 2011, Prokuroria e Tiranës akuzoi fillimisht Ndrea Prendin, i cili ishte komandant i Gardës së Republikës, dhe gardianin Agim Llupo për vrasjen e Myrtajt dhe Veizit. Prokuroria kërkoi respektivisht 23 dhe 25 vjet burg.
Në shtator 2013, Gjykata e Apelit në Tiranë e dënoi Prendin me një vit burg dhe Llupon me tre vjet, duke konkluduar se viktimat vdiqën nga pakujdesia, por se Prendi dhe Llupo nuk ishin fajtorë për vrasje. Vendimi i diskutueshëm shkaktoi reagime të zemëruara nga publiku.
Ndërkohë, prokuroria nuk ngriti asnjë çështje për vrasjen e dy protestuesve të tjerë, Nika dhe Deda, apo për plagosjen me armë zjarri të gjashtë personave të tjerë gjatë demonstratës, dhe e la në pritje për vite me radhë çështjen ndërkohë që kërkonte prova.
Familjarët e viktimave kanë pohuar prej kohësh se Prokuroria e Tiranës, e cila ishte përgjegjëse për çështjen përpara kalimit të saj në SPAK, nuk po e bënte punën e saj me themel.
Gjatë përkujtimit të vdekjeve më 21 janar të këtij viti, Edi Rama, tashmë kryeministër, akuzoi Prokurorinë e Tiranës për mosveprim dhe e cilësoi atë si “pa shtyllë kurrizore”.
Çdo janar, Rama përkujton protestuesit që vdiqën në protestën e vitit 2011 të thirrur nga partia e tij dhe çdo vit bën thirrje që të vendoset drejtësi.
Megjithatë, vetëm dy vjet pas incidentit, Rama krijoi një koalicion me politikanin kundër të cilit protestuesit e 2011 protestonin për gjoja korrupsion – Ilir Metën.
Aleanca me Metën, në atë kohë kreu i Lëvizjes Socialiste për Integrim, çoi në një fitore parlamentare për socialistët e Ramës. Meta tani kryeson Partinë e Lirisë në opozitë.
Anila Hoxha, gazetarja që mbuloi protestën e vitit 2011 dhe më pas çështjet gjyqësore që rrjedhin prej saj, tha se vrasjet e Dedës dhe Nikës kanë mbetur të pa ndjekura penalisht pavarësisht se “çdo përvjetor politikanët janë kujtuar të përcjellin mesazhe duke kërkuar zbardhjen e incidentit”.
Hoxha vuri në dukje gjithashtu se lajmet për progres në vazhdimin e hetimit për vdekjen e Dedës dhe Nikës janë bërë shpesh publike nga sistemi i drejtësisë apo policia e Tiranës “një ditë përpara përvjetorit, ose në ditën e përvjetorit”.
“Por 13 vite nga vrasja e katër personave në bulevard, pavarësisht mesazheve nga politikanët, zgjimit në përvjetorë, marshimeve për drejtësi në bulevard, vrasja e Hekuran Dedës dhe Aleks Nikës nuk ka autorë të njohur dhe për pasojë nuk janë zbardhur”, tha ajo.
Optimizëm dhe kujdes
Afrim Krasniqi, një ekspert politik që drejton Institutin për Studime Politike me qendër në Tiranë, tha se ai e mirëpret vendimin për transferimin e çështjes në SPAK.

"Also, the people who staged such a situation brought individuals to Tirana to confront the police and state institutions", he added - referring to the Socialist Party of Rama, which some blame for organizing the confrontation with the forces of security outside the prime minister's office in 2011.
However, he warned, because the ruling and opposition parties have long sought to avoid blame for the deaths, "there is concern and fear that political interests will prevail over the need for justice".
According to the Albanian media, the family members of Aleks Nika were in the High Court when the decision was taken to investigate the case by SPAK and they were optimistic about the decision due to the reputation of the special prosecutor's office for arresting officials.
