An unusual conflict has erupted in the Dibra Prosecutor's Office, where a prosecutor has initiated criminal proceedings against the institution's head himself. According to media reports, prosecutor Urim Kalia has registered a criminal case against his boss, Abaz Muça, after the latter's illegal action directly violated evidence in a case under trial.
According to the investigation launched by Prosecutor Kalia, the head of the prosecution verbally ordered the police to return a vehicle that had been seized as material evidence in a criminal file against a citizen with a serious criminal record. This person, previously convicted of stalking, resisting law enforcement and narcotics offenses, was the subject of an open trial, for which the seized vehicle had direct evidentiary significance.
The action was carried out in complete violation of the law, as the prosecutor in the case had issued a strict order not to touch the material evidence until the end of the judicial process. However, the vehicle was returned by the police to the defendant with a verbal order from Chief Prosecutor Muça himself. After becoming aware of this intervention, Prosecutor Kalia launched an investigation by seizing the security cameras and documentation of the vehicle's entrances and exits to the premises of the Dibër police station.
When the police were informed of the launch of the investigation, the vehicle was returned to the police station to hide the traces of the illegality. However, the testimonies of the police officers reinforced the accusations, as they stated in the minutes that they had been ordered by the head of the prosecution to return the vehicle.
After opening the criminal case, the prosecutor of the file faced new obstacles. Abaz Muça ordered the secretariat to no longer provide any protocol services to the prosecutor who was investigating it. As a result, the case was sent to the Kukës Prosecutor's Office without any accompanying documents and without a protocol number, a rare and unusual precedent that speaks of direct pressure and blocking of procedural functions.
The Kukes Prosecution has confirmed that the case is under review and that a decision will be made within the legal deadlines, acknowledging that the case is already under its jurisdiction. If the illegal interference with evidence in a criminal case is confirmed, the legal consequences for the head of the Dibër prosecution could be severe, including criminal prosecution and suspension from duty.
This case opens a new chapter on how justice actually works in the districts and raises serious concerns about the influence that can be exerted from within the institutions to manipulate or undo evidence during an active process.
