Who is the judge who holds Berisha's fate in his hands? From the

Judge Elsa Ulliri, who will preside over the trial of former Prime Minister Sali Berisha and 4 other defendants, turns out to have close family ties to one of the Democratic Party MPs. She is Andia Ulliri, who entered parliament after the 2021 elections.

Andia Ulliri also ran in the May 11 elections, on the open list of the Democratic Party in the Durrës district. She is currently "fighting" to get the mandate, as she claims that it belongs to her and not Arjan Ndoja. Ulliri claims that she deserves it with a gender quota.

But is there a conflict of interest between Judge Ulliri, who will review the most important judicial process, and the former prime minister who currently leads the Democratic Party, which includes Andia Ulliri, a close associate of the judge? Can a relative of a Democratic MP judge her political boss?

ABC News officially asked the President of the Special Court Erjon Bani about the conflict of interest and a possible resignation of Judge Ulliri. According to President Bani, the answer is found in Article 15 of the Criminal Procedure Code. But this article has nothing to do with the conflict of interest. The article related to incompatibility is Article 16: Incompatibility due to family ties, gender or in-laws.

In the same proceeding, persons who are, among themselves or with the participants in the trial, spouses, cohabitants, close relatives (pre-born, post-born, brothers, sisters, uncles, aunts, nephews, nieces, children of brothers and sisters) or close relatives (father-in-law, mother-in-law, son-in-law, daughter-in-law, sister-in-law, stepson, stepsister, stepfather and stepmother) cannot participate as judges, reports ABC News.

But who is Elsa Ulliri?

After passing the vetting, Elsa Ulliri was added to the panel of judges at the Court of First Instance for Corruption and Organized Crime in October 2022. The decision was made by the High Judicial Council.

Elsa Ulliri is an experienced judge in the justice system. She graduated from magistrate school in 2014, completed her professional internship at the Tirana Judicial District Court, and was appointed as a judge at the Lezha Judicial District Court in 2015.

For three years, Elsa Ulliri has held the position of deputy president of this court, while she has judged important cases during the exercise of her duties in Lezha.

She has been part of the trial bodies in several important cases, such as: the case against Plarent Ndreca, the Tirana incinerator, the case of the Mayor of Rrogozhina, Vangjush Dako, Metamorfosis, etc.
