During his report to the Laws Committee, the head of SPAK requested a review of the 9-year mandate model, while also presenting the institution's work balance for 2025.

The head of SPAK, Klodian Braho, raised concerns about the status of special prosecutors after the end of their 9-year mandate, during his report to the Laws Committee on the institution's activity in 2025.

According to Braho, the lack of a clear legal solution for the future of special prosecutors could undermine the continuity of investigations and damage the preservation of the expertise created over the years within SPAK. He recalled that the Constitution provides for a 9-year mandate without the right to reappointment, but emphasized that, after several years of operation of the institution, this model should be reassessed.

“The lack of clear legal definition may undermine the continuity of investigations and professional standards, affecting public trust and the fulfillment of the requirements of national and international institutions. The Constitution has provided for a 9-year mandate for special prosecutors, without the right to reappointment. This model has had its purpose in the phase of establishing new justice institutions. However, after these years of operation, it is necessary to assess whether this model sufficiently guarantees the professional continuity of the Special Prosecution Office.

"The end of the mandate of special prosecutors creates not only issues of their individual careers, but also issues of preserving the specialized experience that has been created within SPAK. This experience is related to complex investigations, international cooperation, financial investigation and the administration of cases of high public sensitivity," Braho emphasized.

This issue was previously raised by the former head of SPAK, Altin Dumani, who had suggested that special prosecutors be given the opportunity to run for re-election after the end of their mandate.

During the report, Braho also presented data on SPAK's activity during 2025. He announced that the institution has investigated a total of 871 criminal proceedings, of which 577 were carried over from 2024 and 294 are new cases. Compared to the previous year, the volume of investigations has increased by 4.9%, while 216 proceedings have been completed.

Another indicator that, according to him, proves the change in SPAK's approach is the increase in investigations initiated on its own initiative. Out of 294 new proceedings, 209 were registered on the institution's own initiative.

SPAK has coped with an increasing load without losing consistency in the loss of investigations. An important indicator is the increase in the proactive approach. This shows that SPAK is relying on analysis, financial investigation and not only referrals from other institutions or reports", said Braho.

The SPAK leader also focused on personal security measures, emphasizing that prison arrest is increasingly being used as a measure of last resort. According to him, the number of prison arrests has decreased by 53.4%, from 236 cases in 2024 to 110 cases during 2025.

"Considering imprisonment as the last means of personal security. The measure of imprisonment has decreased by 53.4%, translated into 236 in 2024 with 110 cases in 2025. Of the total measures, about 3.45% are related to corruption, while 21.14% of the total are related to organized crime," said Braho.

Braho assessed that corruption continues to remain a worrying phenomenon, while emphasizing that organized crime groups are operating with increasingly sophisticated structures, using encrypted communications, informal transactions and investments in real estate.
