Fewer votes than Llagami, Asim Vokshi is elected member of the Constitutional

The Supreme Court today elected the new member of the Constitutional Court, thus filling the vacancy created after the end of Holta Zaçaj's mandate.

The new member of the Constitutional Court will be Asim Vokshi, who, although he received fewer votes than Naureda Llagami, from the judges present in the hall, referring to the KED ranking, where he was the most highly rated, will take the mandate on the Constitutional Court.

This is due to the fact that 3/5 of the judges present in the courtroom must vote to elect a new member of the Constitutional Court. However, if the necessary majority is not reached, the candidate ranked first by the Judicial Appointments Council, in this case Asim Vokshi, is considered elected.

Vokshi ranked first in the KED assessment with 89.5 points, followed by Naureda Llagami with 89.3 points and Florian Ballhysa with 77.83 points.

Following them were the candidates Alma Faskaj, Genta Tafa and Alban Toro, who, at least for this appointment procedure, are in the running.

The elected member replaces Holta Zaçaj as a member of the Constitutional Court, while the procedures for electing the new President of the Court will begin immediately thereafter.

Official announcement

A Special Meeting of the judges of the Supreme Court was held in the premises of the Supreme Court, with the aim of developing the voting procedure for the election of a member of the Constitutional Court.

The process was conducted in accordance with the provisions of the Constitution, Law No. 8577/2000 “On the Organization and Functioning of the Constitutional Court”, as amended, and the Regulation approved by the General Meeting of Judges of the Supreme Court.

At the end of the vote, the commission, after verifying the validity and total number of votes for each candidate, concluded that:

Mr. Asim Vokshi – 6 votes

Ms. Naureda Llagami – 8 votes

Mr. Florian Ballhysa – 0 votes

The commission also counted one invalid ballot.

In the circumstances where the legal provisions determine that the candidate who receives 3/5 of the votes of the participants is declared the winner, and in the case of today's vote where none of the candidates reached this threshold, the commission declares the candidate ranked first by the Judicial Appointments Council the winner. Under these circumstances, Mr. Asim Vokshi is elected member of the Constitutional Court.

The decision to elect Mr. Vokshi shall be immediately communicated to the Speaker of the Assembly, the President of the Republic and the President of the Constitutional Court, and shall be published in the Center for Official Publications.
