One day in prison is worth 6 thousand lek, the new changes in the Criminal Code;

The draft of changes to the criminal code, which is expected to be passed to the assembly for discussion soon, foresees some new provisions for replacing the prison sentence with the payment of a sum of money to the state treasury. Apparently, such an initiative aims to reduce overcrowding in prisons by providing alternative options for serving sentences to persons accused of minor criminal offences. In the proposed changes, in articles 137 and following, it is stated that the court, in cases where a light criminal offense has been committed and its author fulfills all other criteria, at his request, the court can decide to replace the prison sentence with the payment of a sum of money in favor of the state, calculating one day of imprisonment with six thousand lek.

The court declares the unreplaced decision and sets the 10-day deadline as the limit, within which the convicted person must pay the amount of the fine that converts the time of the prison sentence. The payment of money in favor of the state is made after the decision is given. But this substitution cannot be decided without listening to the victim if there is also a prosecutor, but in the code there are also limitations as it is determined that no provision is applied in cases of criminal offenses committed by public servants, criminal offenses of corruption, criminal offenses against justice, those of trafficking and against the person or domestic violence.

Changes have also been made in the calculation of detention. In the new code, the time of detention or house arrest is counted in the prison sentence or fine, as well as in the obligation to perform a work of interest. Thus, one day of detention equals one day of imprisonment. One day of detention equal to seven thousand lek fine.

One day of detention equal to twenty hours of public interest work. What about house arrest? one day of house arrest is equal to one day of imprisonment. One day of house arrest is equal to 3 thousand Lek fine. In the draft of the changes, it is stated that one day of house arrest is equal to 15 hours of work in the public interest. This method of calculation must be applied by the prosecution and the courts in the event that the amendments to the Criminal Code are approved and come into effect./ Albanian
