Pact for immigrants, the lawyer overthrows the government: We have a criminal

Albania and Italy have signed an agreement for immigrants today. Prime Minister Rama has agreed to give Italy the port of Shengjin and Gjadri, in order to accommodate the immigrants.

But for lawyer Jordan Daci, this contradicts international conventions. According to him, the territory cannot be under the control of any country other than NATO within the framework of military missions.

The territory of RSH cannot be under the control of any other country with the exception of NATO in the framework of missions and clearly only military purposes. The recognition of the jurisdiction of a foreign state within the territory of the Republic of Slovenia is done only on the basis of the Vienna Conventions for diplomatic purposes only in the form of extraterritories.

An agreement that recognizes the jurisdiction of a foreign state over a part of the territory of the Republic of Slovenia would constitute a criminal offense and could never be subject to approval by the Government (this has no constitutional competence to do so) nor ratification by the Assembly. Such an agreement contradicts almost half or more of the Constitution and the principles of International Law. If the President has issued full powers for the negotiation of this agreement, he has seriously violated the Constitution of the Republic of Slovenia, and if not, the agreement is invalid according to the Vienna Convention on the Law of Treaties and the decision of the Constitutional Court in the case of the sea agreement with Greece. Meanwhile, the Government is prohibited from negotiating agreements on behalf of RSH without the full authority of the President of RSH.

Every person who is in RSH is subject to the law and the Albanian courts and no agreement can transfer the jurisdiction or deny these citizens access to the Albanian courts and not only. Meanwhile, according to international laws, the RS would be responsible for everything that happens to these citizens in front of the countries of which they are citizens and in front of international courts.

In the end, in no case is there any mechanism that ensures without exception their repatriation and these citizens would remain in RS without having the possibility of repatriation and their number, etc., would inevitably affect the demographic composition and harm the long-term interest national.
