
Lawyer Gentian Rumano has stated that Erion Veliaj has the right to appeal the decision to dismiss him from the position of mayor to the Constitutional Court.
According to Rumano, there are two procedural violations in the City Council's decision to dismiss the mayor; that he was not heard and that he was not provided with legal protection since the reasons for the dismissal were not presented to him.
With these two reasons, Rumano explained, the Constitutional Court can overturn the municipal council's decision-making as incompatible with the Constitution, leaving Veliaj in office.
" The moment you did not notify the reason for the dismissal, you committed a procedural violation. With these procedural violations, the reason for his dismissal was that the municipality was without a leader, which is not provided for by Article 62, but is a reason in the public interest, so an efficient mayor is needed, to be at work. The moment he will appeal to the Constitutional Court, with the first reason, that he was not heard and that he was not provided with legal protection, by not presenting the reason for the dismissal, which are standards of the constitution, when he addresses the constitutional court, he has the right to overturn this decision and Veliaj to remain in office by declaring the decision-making of the municipal council and the council of ministers incompatible. There is a procedural moment, which can create a legal impasse; the decision to propose dismissal is an administrative act, which must be challenged in the Administrative Court or an act that must be challenged in the Constitutional Court ," said the lawyer.
