The Centralized Purchasing Operator, created by decision of Prime Minister Edi Rama and which carries out around 70 percent of public institutions' procurements, has become one of the most contested structures in the tendering system.
Especially in the last two years, after this operator was transferred from the Ministry of Interior to the Ministry of Economy, Culture and Innovation, complaints about lack of competition and favoritism towards certain companies have increased.
Arlinda Pogaj, a close associate of Blendi Gonxha in several previous positions at the Municipality of Tirana, the Parks Agency and the General Directorate of Road Transport, was appointed to head this institution. She currently heads the Centralized Purchasing Operator under the formal subordination of the Minister of Economy.
According to media reports and business complaints, a significant portion of the procedures were conducted with a single participant, with contracts reaching 97 to 100 percent of the limit fund and with limit funds set above market prices.
Many of these tenders have been reported to SPAK by participating companies, who claim that they were faced with inappropriate criteria and unjustified disqualifications.
In this climate of accusations, the operator's manager organized a forum on the topic of "Promoting business participation in procurement procedures", where transparency and competition were discussed.
According to her, in 1000 procedures for 216 public institutions, 35.5 million euros were saved from contracts with lower bids. However, audit reports by the Supreme Audit Office and the Ministry of Finance have identified cases where the limit funds were set above the real market value and where the lack of competition has limited potential savings.
Complaints from disqualified companies and official audits have raised questions about procurement standards and the influence of political structures in the process.
The Centralized Purchasing Operator remains today one of the main nodes of public funds administration, while accusations of clientelism and lack of competition require a full institutional investigation and full transparency on the procedures developed./ Pamphlet
