The chairman of "Albania Becomes" Adriatik Lapaj received another blow on Wednesday from the KAS, which decided to overturn the decision of Ilirjan Celibashi and decided to take the mandate from Kleana Xhuveli and pass it to Ana Dajko. Lawyer Indrit Sefa, invited to "Real Story", said that with this decision the KAS standardized a rule, which was unclear.
"The Commissioner said that I do not recognize resignations from candidacy, at this moment, the candidate of Albania Becomes, Ana Dajko had resigned from candidacy, not from the mandate. KAS says that the lady has not expressed herself regarding the mandate, but she should receive the mandate first according to the law and she should go and submit her resignation to Parliament. The same thing happened in PSD, but no one complains there.
"The KAS got the unexpected opportunity from Albania. It is done, which standardized a rule that was unclear. It regulates only what is complained about. It becomes a precedent in the future. The Commissioner in the near future is obliged to refer to the KAS decision ," Sefa added.
He emphasized that with the KAS decision, a new problem has arisen, which according to Sefa, is that regardless of whether all candidates on the closed list withdraw, a woman must always take the mandate.
"The other problem that arises, with the KAS decision that was given yesterday, is that even in cases where Ms. Dajko withdraws from Parliament, in all cases a woman must receive the mandate. If the entire closed list is gone, the one with the most votes in the open mandate will still receive it ," he said.
