The draft amendments to the Criminal Code, currently in the public consultation phase, has been harshly criticized by Artan Fuga for its unclear wording and the use of metaphorical language that, according to him, contradicts the precision of the law.
"The text is filled with poetic and prosaic metaphors that are not legal concepts and, being such, they can be interpreted like an accordion, like a rubber band. This will create endless problems. For example, it says: the desecration of the nation is punished. Anything can be called desecration, even criticism. Or it says: the images of a person that make him or her disgusted by the public. What does this mean? Prolongation of judicial processes, subjectivism," he adds.
Another issue that concerns him is the punishment of individuals who publish sensitive data, as a violation of freedom of information, under the alibi of "obstruction of justice".
"There are endless anonymous publishers. Today we live in the age of the web. We do not live in the age of the newspaper Zëri i Popullit. Who is the publisher? The owner of the media? The one who runs the platform? Is it the journalist who is responsible? Or all of them? Revealing a secret can hinder justice, but it can also help it, because it is treated as if the journalist is an enemy of justice! ", concludes the academic.
