The National Chamber of Advocacy has objected to some controls that SPAK and BKH have exercised in law offices, within the framework of criminal investigations. One of the latest cases is the control in the gallery of Ajola Xoxa, the wife of the mayor of Tirana, Erion Veliaj.
Chairman Maks Haxhia explains to Top Channel that the checks inside these premises were also made in the office of the lawyer Gerta Domi, without the presence of a representative of the bar, which is in violation of article no. 52 of the criminal procedure code. .
" In the office of the lady, Gerta Domi practiced the profession of lawyer and a lawyer, a member of the Tirana Bar Association. And the law takes special protection that you cannot check the premises of a lawyer's office and other persons who are in that office without notifying the lawyer's room, which must come within two hours, be present and check and observe and to hold in particular interest the treatment of how control is done. This is also a serious violation, and if these things are not implemented by the investigative bodies and the court, all of this means that even if there is evidence, this evidence is invalid ," Haxhia said.
According to Haxhi, in the lawyer's office there are also documents of other clients, which are not related to the relevant investigation, for which the investigation body has no right to check, but should focus only on the case that has a court decision.
"These things, as we are seeing, are happening often and are happening often because the court has opened its arms, has become a party to the investigation, under the guise and under the impression of the opinion of the fight against corruption, the fight against organized crime, but such precedents are very dangerous because they lead to arbitrariness, they lead to dictatorship, they lead to the extremes of the behavior of state bodies and at the same time they ignore the human being in relation to basic rights" , he said.
