
Men who have been sentenced by a final decision or have 3 years left in prison and the decision has become final by December 31, 2025, and women who have been sentenced to 4 years in prison by a final decision by the end of last year, with the exception of some categories of criminal offenses, will be released immediately if the Parliament gives the green light to this draft criminal amnesty that the government has prepared.
The draft that will be passed by the Council of Ministers to the Parliament is published, from which over 10 thousand people are expected to benefit, with 380 prisoners expected to be released immediately and 980 others receiving reduced sentences.

Immediate release will also benefit all women who, by the time this law enters into force, will have 4 years left in prison to serve, regardless of the sentence, or men who, by the time the law enters into force, will have 3 more years in prison, regardless of how long they have been sentenced.
Excluding all those convicted of a number of criminal offenses, all women who are over 50 years old at the time the law comes into force or men over 60 years old, or even young convicts who were 18 years old or younger at the time of committing the criminal offense, will also be released.
They are immediately released from prison (with exceptions by law):
Men sentenced to 3 years or less
Women sentenced to 4 years or less
Men with up to 3 years remaining in prison
Women with up to 4 years remaining in prison
Men who are 60 years old or older
Women who are 50 years old or older
All those who were 18 years old when they committed the crime
Reduction of sentence
In addition to the approximately 380 prisoners who will receive immediate release, approximately 1,000 others will have to be content with a reduced sentence. The draft provides for a reduction in sentence by 1 year for men and 1.5 years for women and minors. But even here, all persons convicted by the Criminal Procedure Code, those sentenced to life imprisonment, those who have evaded justice and those convicted of murder in qualifying circumstances, the murder of a public official, the murder of a police officer and murder in the family are excluded.

Discontinuation of criminal prosecution
Nearly 9,000 other citizens are expected to benefit from the criminal amnesty through the termination of the investigation or trial against them. So, no further investigation or trial will be conducted against them. The draft provides for exemption from criminal prosecution for all cases under investigation, unexamined cases, as well as reports filed with these bodies, regardless of the date of their registration, for crimes committed until December 31, 2025. This applies to offenses for which the Criminal Code and the Military Criminal Code provide for a sentence of up to 3 years in prison, with the exception of offenses that have prohibitive criteria.
Who is exempt from amnesty?
Excluded as beneficiaries of this criminal amnesty, in addition to a reduction of one or one and a half years in sentences, are all those convicted of serious criminal offenses, a total of 19 such categories, ranging from crimes against humanity, crimes against life, sexual crimes, offenses against children, offenses that affect free elections, armed gangs and criminal organizations, as well as offenses of corruption.

All fugitives and those who have evaded justice do not benefit from any category of amnesty, including release, reduction of sentence or even cessation of criminal prosecution.
