Tirana Mayor Erion Veliaj has filed a request with the Special Court to disqualify Judge Etleva Deda from the criminal case against him, claiming that the principles of due process were violated during the preliminary hearing. The request was filed on February 2 and officially registered on February 4, and is expected to be reviewed by Judge Bib Ndreca.
According to the defense, the concerns relate to the February 2 hearing, where Veliaj and his lawyers claim that he was not guaranteed a real and effective defense. The lawyers argue that the mayor was forced to defend himself personally, while the court assigned him a lawyer, mainly without his consent, who, according to them, had not had the time and opportunity to familiarize herself with the investigative file.
The defense emphasizes that the request for additional time to prepare the defense was rejected, despite the fact that it was a voluminous file of about 61 thousand pages, while the court considered the defense completed. According to the lawyers, this made it impossible to exercise a full defense.
In the request for disqualification, the defense also raises concerns about the position of the Special Prosecution Office, describing it as biased and detrimental to the rights of the defendant. According to them, the judge has also taken a position that creates the perception of siding with the accusation.
The request for the disqualification of Judge Etleva Deda comes at a crucial moment in the process, as the GJKKO is expected to announce on February 9 the decision on whether or not the case against Erion Veliaj and the other defendants will proceed to trial. Meanwhile, the mayor of Tirana continues to be held in pre-trial detention, after his request to replace the security measure "arrest with prison" was rejected.
