After being officially declared a defendant, the Special Prosecution Office has communicated the indictment to the chairman of the Public Procurement Commission, Jonaid Myzyri, on Monday. According to SPAK, he is accused of the criminal offense of 'violation of equality in tenders'. The case concerns the tender for the maintenance of the Shpal-Ura e Repsit road axis, which is 58.7 kilometers long and worth 2.2 million euros.
Meanwhile, the GJKKO suspends him from duty and has imposed a mandatory appearance measure on him. In total, 11 defendants.
"At the request of the Special Prosecution Office against Corruption and Organized Crime, the Special Court of First Instance, within the framework of criminal proceedings 175/1 of 2022*, with decision no. 61, dated 30.06.2025, has imposed a security measure against the citizen, JM, who holds the position of Chairman of the Public Procurement Commission, suspected of committing the criminal offense: "Violation of equality of participants in tenders or public auctions", committed in collaboration, provided for by articles 258 and 25 of the Criminal Code, to whom the charge has been communicated.
The imposed measure includes "Suspension of the exercise of a public duty or service", provided for by Article 242 of the Code of Criminal Procedure, as well as that of personal security with a coercive character, "Obligation to report to the judicial police", provided for by Article 234 of the Code of Criminal Procedure.
The Special Prosecution Office against Corruption and Organized Crime in Tirana has sent for execution the decision, no. 61, dated 30.06.2025, of the Special Court of First Instance.
The object of this criminal proceeding was the prosecution procedure, with no. REF-65268-07-13-2020, “Lot V: “Routine maintenance with performance of the Rrëshen (Fanit Bridge) – Shpal, Shpal – Q. Bene – Hadroj, Shpal – Repsit Bridge” road, with a limit fund of 219,866,693 lekë excluding VAT, developed on 18.9.2020, with the contracting authority Albanian Road Authority (ARRSH).
The review of the procedure by the contracting authority contained illegalities, which the Public Prosecution Commission did not take into consideration.
During the review of the complaint of the above procedure, this Commission, unlawfully favored the merger of economic operators; AM, and D.-1., where after investigative actions it resulted that they submitted forged documents.
For this procurement procedure, the following defendants have been taken into custody: JM, V.Zh., LS, MZ, EB, VH, GA, and AH, suspected of committing the criminal offense: "Violation of equality of participants in tenders or public auctions", committed in collaboration, provided for by Articles 258 and 25 of the Criminal Code, as well as citizens; ML, NK, and AK, suspected of committing the criminal offense "Forgery of seals, stamps or forms", provided for by Article 190 of the Criminal Code", SPAK announced.
The file of the head of the Public Procurement Commission is being investigated by prosecutor Elvin Gogaj, who decided to change Myzyri's status from a person under investigation to a defendant. As on other occasions, Jonaid Myzyri has not preferred to speak to the media from SPAK premises.
