The Supreme Court has decided to annul the "Compulsory Appearance" measure that SPAK imposed on November 24, 2024 against "Ora News" journalist Elton Qyno.
The decision was made by the trio of judges Albana Boksi, Ilir Panda and Medi Bici, who unanimously rejected the request submitted by SPAK, which requested the High Court to impose the security measure of mandatory appearance on the journalist.
At the end of the trial, the trio of Supreme Court Judges upheld the decision of January 14, 2025, of the Special Court of Appeal, a decision which "revoked" the paralyzing measure that SPAK imposed on journalist Elton Qyno.
The Appeals Court's decision argued that journalist Elton Qyno had not committed any criminal offense while exercising his journalistic duties and, furthermore, added that Qyno lacked reasonable suspicion, a criterion that creates the conviction for imposing a security measure against an individual.
Thus, in contrast to the assessment of the judge of the Special Court of First Instance, I consider that the Appellant, journalist Elton Qyno, cannot be subject to personal security measures, because there is no reasonable doubt, based on evidence, regarding the presence of the criminal offense of "Passive corruption in the private sector" against him.
The appeal considered all of Journalist Qyno's writings to be true and of public interest, due to the criminal events that had occurred in the Elbasan-Peqin-Rrogozhinë and Durrës segment.
In November 2024, the SPAK Special Prosecution Office undertook a police operation in Tirana and Elbasan, targeting Suel Çela and other individuals.
Among the 21 people whom SPAK imposed security measures and initiated criminal prosecution for various offenses were the two journalists from Kronika e Zezë, Elton Qyno and Artan Hoxha.
Meanwhile, in April 2025, the Constitutional Court issued an 8-0 decision in favor of Journalist Elton Qyno, in his right to protect professional and journalistic sources, declaring all actions carried out by SPAK prosecutors unconstitutional.
