On February 7, 2024, on the show "Opinion" on TV-Klan, the Director of the State Cyber Security Certification Agency, Igli Tafa, spoke about the attack on INSTAT by the "Homeland Justice" hacker group, giving assurances that their intervention did not cause damage.
To the question, whether the hackers have taken or damaged the data of "CENS-2023", the director Igli Tafa answered: - The data of CENS have not been affected, because they are not located in INSTAT, but all the tablets are in another place and it is administered by a third party that is not part of INSTAT.
This statement reveals a serious state scandal, that the data of Albanians, officially collected confidentially door-to-door, with the state guarantee that they are safe, the government took from INSTAT, took them out of INSTAT and gave them to a private group whose identity and whereabouts are unknown.
According to Article 2 of Law no. 17/2018, the collection and production of state statistics, or physical or electronic data of citizens, are processed and kept only within the premises of INSTAT; while in articles Article 31 and 32 of the law, it is stated that INSTAT maintains confidentiality, knowing only the authorized employees.
In Article 9 of Law no. 140/2020, it is stated that INSTAT ensures the confidentiality of CENS data on population and housing, without removing them from the premises of the institution, neither before nor after processing, except after 10 years when it is taken to the archive.
But according to the Director of the Cyber Security Certification Agency, Igli Tafa, the data of "CENS-2023" are not in INSTAT, but have been given to a third party outside this institution and outside the government, who are unknown, by which country they are and where they are keeping the data.
So, the 6,000 tablets with the collected data were not delivered to INSTAT, as the institution authorized by law that made the CENS, but to persons who are not INSTAT employees.
SPAK should investigate this scandal as an organized state crime, committed knowingly and with the intention of falsifying the data of "CENS 2023"; action kept secret until now, but made public by the director of cyber security.
In addition to the fact that the law prohibits the release of CENS data outside the institution, they are kept and processed by a third party; when INSTAT has employed 1200 processors only for the data of this process, and has 243 specialists, it has received nearly 17 million Euros from the state.
According to the information, the only clue to this scandal is this: Prime Minister Edi Rama has ordered the Director of INSTAT, Elsa Dhuli, that the tablets with the data collected for "CENS-2023" be processed by a group outside INSTAT.
