The investigation file on the issue of sterilization has been revealed.
In the SPAK file, it is said that the 8 people charged are charged with four charges, while the security measures against the former deputy minister, the businessman and 6 other people were issued on July 3, and were executed 1 and a half months later.
"On July 3, 2023, the prosecutors of the Special Prosecutor's Office, Edvin Kondili and Ened Nakuçi, after getting acquainted with the acts of the criminal proceedings, concluded that on 13.01.2020, criminal proceedings no. 13 of 2020, which is about the criminal offenses of "Abuse of duty", "Violation of equality in tenders", Passive corruption of high state officials or local elected officials" in relation to the procedure for awarding concessions for "services integrated for the provision of a personalized set of surgical instruments and the supply of disposable sterile medical material in the surgical rooms, as well as the treatment of biological waste and the disinfection of the surgical rooms", from the Ministry of Health.
From the acts, it appears that in the Special Prosecutor's Office against Corruption and Organized Crime, the subject Nisma Thurje has filed a criminal complaint against the public officials involved in the concession of sterilization of surgical equipment, who, with their actions, may have consumed elements of the criminal offenses of abuse of office, violation of equality of participation in tenders and/or passive corruption using public power for private benefits. From the content of the predicate material it follows that:
According to the file published by TCH, "starting from the contract made public, based on the reports of institutions and media publications, Nisma Thurje expressed concerns:
First, there were doubts about the need to receive this service from a third party in the conditions when for decades it was performed by the public hospitals themselves.
Secondly, there were doubts about the procedures for providing this service with a concession. In the conditions where the Ministry of Health has judged that this service should be provided by a third party, it remains to be seen whether the path provided for in Law No. 125 of 2013 and VKM No. 575 of 2013 and 27 of 2007. According to the complainant, it seemed clear that the Ministry of Health avoided the procedure of prosecution of the open tender service, as was done with other hospital services such as laundry and food.
Së treti kallëzuesi ngre dyshime për përmbajtjen e kontratës koncesionare nëse është hartuar në një formë të atillë që shkakton dëme financiare buxhetit të shtetit, si fillim kallëzuesi sugjeron të hetohet nëse është parashikuar në kontratë që Autoriteti i siguron koncesionarit energjinë elektrike, ujin, avullin, veprat civile, impiantet dhe ambientet e nevojshme me shpenzime në ngarkim të Autoritetit? Përse Ministria mund të ketë gjykuar që ndërkohë koncesionari paguhet për shërbimin e sterilizimit, infrastruktura të vihet falas në dispozicion nga spitali, ndërsa shpenzimet bazë si energjia elektrike, avulli, uji të paguhen nga buxheti i shtetit? Ky shqetësim i kallëzuesit ka parasysh edhe raportin e Kontrollit të Lartë të Shtetit, në të cilin është konstatuar se në Spitalin Universitar të Traumës si pasojë e kësaj kontrate koncesionare ka pasur një rritje të konsumit të energjisë elektrike me vlerë rreth 32000 euro. Po duke iu referuar KLSH-së, në spitalin e Durrësit, koncesionari nuk ka ndjekur procedurën ligjore për marrjen me qira të ambienteve të spitalit dhe ka rritur kostot e spitalit për energji elektrike dbe ujë në vlerë 7,706,844 lekë.
Së katërti kallëzuesi ngre dyshime për çmimin e shërbimit të dakordësuar në kontratë. Vlen për t’u hetuar sipas tij nëse kompania ka investuar vërtet 12 milionë euro, sipas parashikimit, duke hetuar inventarin e kompanisë dhe duke verifikuar cilësinë e produkteve edhe pse nëse bëhet një llogari e thjeshtë gjendet arsye jo vetëm në kryerjen e këtij investimi, por edhe nevojën për një koncesion të tillë. Si përfundim, kallëzuesi në cilësinë e mjekut, qytetarit, pro mbi të gjitha si taksapagues, shtron pyetjen përse duhet të paguajmë 17 milionë euro në vit një koncesion për një shërbim që shteti mund ta kryente vetë shumë më lirë? Pas regjistrimit të procedimit penal nga ana e policisë gjyqësore janë kryer një numër i madh veprimesh hetimore në përfundim të cilave më datë 23.06.2023 janë caktuar masat e sigurimit”.
Kontrata e sterilizimit u firmos në vitin 2015 nga ministri i Shëndetësisë dhe biznesmenit të kompanisë “Sani Service”, ndërsa edhe pse u kundërshtua nga ish ministri i Financave, edhe ai e miratoi, i cili ishte ditën e djeshme në SPAK.
Kujtojmë se 8 persona u vunë nën masa sigurie nga GJKKO, tetë vite pas firmosjes së koncensionarit të sterilizimit dhe tre vite pasi çështja u kallëzua në SPAK.
Ish zëvendës ministri i Shëndetësisë, Klodian Rrjepaj, në cilësinë e kryetarit të komisionit për koncensionarin me vlerë fillstare 9.6 miliardë lekë përfundoi nën arrest me burg për shpërdorim detyre.
Së bashku me të edhe biznesmeni Ilir Rrapaj, që dyshohet për mashtrim me pasoja të rënda dhe që kryeson konsorciumin.
In addition to eight persons, GJKKO has suggested to SPAK to prosecute six other persons, including the former Minister of Health, Ilir Beqja and the former Minister of Finance, Shkëlqim Cani.
SPAK states that it has separated the investigations for other suspected persons in the public private partnership contract, reported in December 2019 by Nisma Thurje.
