Scandal/ How the two people accused of murdering the 15-year-old in Gramsh were

Fiks Fare followed for several days the case of the murder of 15-year-old Fatjon Bici, in May 2023 in the city of Gramsh. The father, mother and family asked for the help of the investigative show, after two of the perpetrators of their son's murder had been released from prison, without giving them any explanation.

Fiksi inquired at the Gramsci Police where he learned that the release was made by the court and that the two perpetrators should be kept under house arrest. Meanwhile, Fiksi became interested a few days ago in the Appeal of Tirana where he learned that the release decision was made due to numerous delays in the investigation and trial process in the Prosecutor's Office and the Court of Elbasan. The two perpetrators had more than 18 months in the cell and the law provides that they cannot stay in the cell any longer. Meanwhile, today, on December 12, 2024, the next session took place and after the interest of "Fiks Fare", the Appeal returned the two perpetrators to the cell, and even upheld the decision of the Court of Elbasan.

Mother's cry: They are "playing" with my son's blood!

A few days ago, the group of Fiks Fare traveled to the city of Gramsci, after the request for "help" from the family members of the victim Fatjon Bici. Mustafa and his wife asked for the help of Fiks Fare because they accidentally learned that the murderer of their son, Ergi Karaj, has been released from prison.

For the event of May 2023, they show that the mother was notified by the teacher and was told that her son was a little restless. The moment they went, they found the boy lying on the ground, dead at the scene near the 9-year-old school "Asllan Shahini". According to family members, the apple of the quarrel was a friend of their son Qetsor H. The perpetrators started to quarrel with Qetsor and their son intervened to separate them. They say they stabbed him several times in the heart and there were stab wounds all over his body.

Parents are very concerned about the court hearings and how they were conducted. Sometimes the judge did not come, another time the prosecutor. After the decision was taken for 18 years in prison, they appealed again and the trial was postponed to December 12 in the Appeal of Tirana.

Meanwhile, 2 of the perpetrators, one of whom is the main one, Ergi Karaj, who was sentenced to 27 years in prison (shortened sentence of 18 years), has returned home under house arrest. The family members of the victim learned this news from various residents of Gramsh. Then they had a conversation with the head of the police station who told them that this is true and that he is at home under house arrest. The family members demand the imprisonment of the perpetrators, without a summary trial and that justice be done.

The victim's mother bursts into tears and says that "they took my son". "There is no state, they should be in prison, "my son is in the ground", who will think about that. They are playing with my son's blood," says Afërdita Bici.

After the complaint, the family members of the victim go to the Police Station in Gramsh, where they ask to meet the Chief of the Station, but he is not there and they talk to other employees. The employee admits that the perpetrators are at home, being guarded by the police. They don't let them leave the house, because they are under house arrest as a security measure. They are serving their sentence until another decision is made.

The police officer tells the family members that "there is no justice here, there is no court and it should not fall to anyone". He adds that the perpetrators took him to Apel and created a loophole there and are now under house arrest. "We create problems to keep the criminal and stay in the cell. We are also parents and we say what happens like this. He should be imprisoned for life," the policeman tells the family members.

"We will do terror, the knife in the throat", the testimony of the killers

Fiks Fare has secured the investigative and judicial file of the murder of the 15-year-old. In the file, the authors say in the "Tik Tok" and "Snap Chat" applications that "we will commit terror." They even buy knives and gloves online in the city of Gramsci, despite being minors.

They testified that they shot him several times, the target was the other person, but the victim came forward. They show that they are busy on social networks with each other, insulted and insulted. "They hit Ergi in the face and then Ergi had a button knife in his right hand and stabbed him in the back with a knife. When the police caught us, Ergi threw away the bloody knife," testified one of them.

Another witness says that "in the Tik Tok application I was asked if I knew Qetsor and that there were problems with him and he was going to fight. I installed the 'Snap Chat' app, where Orgito would send me pictures of iron gloves and knives. In one of the messages, Orgita wrote to me, saying that 'he saw the picture of the iron glove' that I sent to Snap Chat, as I will come with these tools.

The file contains details from the inspection of the authors' phones, where Orgito's phone contains 7 photos that mention the purchase of gloves. In "Tik Tok" there are conversations with the user Rudolf where it is mentioned by Orgito "tomorrow you will see terror, see. Tomorrow you will see."

Even the conversations on "Tik Tok" give details of what they will do, even the author Ergi Karaj with boxing gloves, the conversation with Orgito who admits that he has a knife and comments that "knife in the throat", "knife in the stomach".

The protracted process led to the release of the perpetrators

In the file is also the final conclusions of the prosecutor Neritan Hoxha, who requested the punishment of the main perpetrator Ergi Karaj with 12 years in prison (with a shortened trial of 8 years). For Stiven Murat, Orgito Çarçi and Jhonatan Çekrezi, he demanded a sentence of 6 years and 8 months in prison each.

Meanwhile, the court, unlike the prosecutor, sentenced the main perpetrator to 27 years in prison and with a shortened trial to 18 years in prison. Steven Murat with 6 years and 8 months in prison. Orgita Çarçi with 14 years in prison and Jhonatan Çekrezi with 8 years in prison.

The decision of the court was given by majority, while one member of the court also had a minority opinion. Judge Thomaidha Roça thinks that the summary trial should not be accepted, since the legislators have written in the Code of Criminal Procedure that "the request for summary trial is not allowed for the criminal offenses for which the sentence of life imprisonment is foreseen".

The proceeding was registered on May 17, 2023. The prosecution sent the file to the court on November 17, 2023. Six months later, on April 29, 2024, the decision was given by the Court of Elbasan. The procrastination has continued even with the announcement of the decision. The judges submitted it to the secretariat in July 2024. And, only in September of this year, the file was submitted to the Tirana Appeal. In the session of November 14, the judge of Appeal Fuat Vjerdha was ill and the case was postponed to December 12. If the hearings are postponed due to the fault of the prosecution and the court, the terms of detention are not suspended.

On December 4, with a sudden decision, judge Fuat Vjerdha made an interim decision, changing the measure of arrest from prison to house arrest for the two main perpetrators, Ergi Karaj and Orgito Çarçiu, sentenced to 18 and 14 years in prison by first degree. The justification was because the power of detention has been lost, due to unjustified delays in the investigation and trial.

In the session of December 12, 2024, Fiksi went to the Appeal of Tirana, where he participated in the session. The trial was held behind closed doors, because the perpetrators are minors. In the process, the victim's family members asked the judge for the reason for the release. The judge reasoned that the power of detention has been lost due to delays. In the end, the court decided to uphold the decision of the Court of Elbasan.

"I wanted them to be punished as the letter says, not with a summary trial. I have been up and down for 1 and a half years. Even now, I didn't get justice," Mustafa Bici, the victim's father, told Fiksin.
