The Special Court has decided the security measure 'obligation to appear' for the former Minister of Health Ilir Beqaj, accused of abuse of office and abuse of the sterilization concession.
SPAK has decided that Beqaja's passport will be blocked and she will not be allowed to leave the territory of the Republic of Albania without the authorization of the court.
The decision to set the measure of personal security was signed on November 16 by GJKKO, while it was executed by the National Bureau of Investigation and the General Directorate of the State Police the day before.
Therefore, Beqaj is charged with the violation of the equality of participants in public tenders or auctions" carried out in cooperation" Passive corruption of high state officials or local elected officials in connection with the concession award procedure "For integrated services for the provision of a set of customization of surgical instruments, the supply of disposable sterile medical material in surgical rooms, as well as the treatment of biological waste and the disinfection of surgical rooms", the Ministry of Health informed SPAK today.
According to this decision, the person under investigation is ordered to appear before the judicial police of the National Bureau of Investigation, once a week, on Fridays, at 3:30 p.m.
" On 13.01.2020, the Special Prosecutor's Office Against Corruption and Organized Crime registered criminal proceedings no. 13 of 2020, which deals with the criminal offenses of "Abuse of duty" in cooperation, provided for by article 248-25 of Criminal Code, "Violation of the equality of participants in public tenders or auctions" carried out in collaboration, provided by article 258-25 of the Criminal Code, "Passive corruption of high state officials or local elected officials" provided by article 260 of the Criminal Code , in relation to the concession award procedure "For integrated services for the provision of a personalized set of surgical instruments, the supply of disposable sterile medical material in surgical rooms, as well as the treatment of biological waste and the disinfection of surgical rooms", from the Ministry of Health .
In continuation of the investigations for this criminal proceeding, at the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime, with decision no. 119 act dated 16.11.2023, decided as follows:
· The assignment to the person under IB investigation with the duty of former Minister of Health, of the security measure "Compulsion to appear at the Judicial Police" and "Prohibition of leaving the country", provided by articles 234 and 233 of the Penal Code, as suspected of the criminal offense of "Misuse of duty" committed in collaboration, provided by articles 248 and 25 of the Criminal Code.
· The person under IB investigation is ordered to appear before the judicial police of the National Bureau of Investigation, once a week, on Fridays, at 3:30 p.m.
· The person under IB investigation is ordered not to leave the territory of the Republic of Albania without the authorization of the court.
· The use of the passport and other valid means of identification for exiting the country, for the person under IB investigation, is prohibited.
The decision to set the measure of personal insurance was executed by the National Bureau of Investigation and the General Directorate of the State Police (on 17.11.2023).
The investigations continue in the direction of establishing the criminal responsibility of other persons who during this procedure have committed actions in violation of the law and the regular fulfillment of the duty, " the announcement states.
Former Deputy Minister of Health Klodian Rrjepaj and businessman Ilir Rrapaj have been arrested by GJKKO in connection with the concession worth 100 million Euros for the sterilization of surgical tools, for which the investigations started 3 years ago. Also, 8 arrest warrants were issued for the case by court decision (GJKKO), for former officials of the Ministry of Health: 2 people "prison arrest", 2 "house arrest" and 4 "compulsion to appear".
For 4 former officials, the measure of "obligation to appear" has been set, namely for Naile Ajazi, Arben Gjata (Rector of the University of Medicine), Genc Burazeri and Pertef Mersini. All four are accused of "forgery and abuse of office". 2 other former officials of the Ministry of Health were placed under house arrest: Saimir Kadiu (economic director) and Marsela Serjanaj (legal director).
