The Special Prosecutor's Office (SPAK) has closed the investigations and has sent for trial the file of 4 foreign citizens who are suspected of having acted as a structured criminal group in the trafficking of persons from 3rd countries, using Albania, towards the EU countries -'s.

They are accused of the criminal offenses of "Aiding illegal border crossing", "Structured criminal group".

It is suspected that these citizens, after securing various people mainly in Iraq, Syria, Egypt and other countries against a monetary reward of 5,000 to 10,000 Euros, crossed them illegally by land and sea with the final destination of the EU countries.

SPAK has brought to trial the citizens Yahia Yussef (alias Kamal Kamil) from Egypt, Soran Saber from Iraq, Yalcin Ali Hanci and Mustafa Koseoglu from Turkey, in our country they cooperated with Albanian citizens and trafficked illegal immigrants from the Middle East to countries of EU.

The announcement of GJKKO:

1. The Special Prosecutor's Office against Corruption and Organized Crime on 09.12.2023 submitted to the Court the request with the object: Sending for trial the criminal case no. 148/2020, in charge of the defendants Yahia Yussef (alias Kamal Kamil), Soran Saber and Yalcin Ali Hanci, who are accused of the criminal offenses "Aiding illegal border crossing", "Structured criminal group", "Commitment of criminal offenses by criminal organization and structured criminal group", provided for by articles 298/1 . of criminal offenses by criminal organizations and structured criminal groups", provided by articles 298/1, 28/4, 333/a/2 and 334/1 of the Criminal Code.

2. In the session of 31.07.2024, the Special Court of First Instance for Corruption and Organized Crime (preliminary session) with a panel composed of judge Flora Hajredinaj, after examining the claims of the parties, with decision No. 31, dated 31.07.2024 decided:

I. Accepting the request of the Special Prosecution Against Corruption and Organized Crime to send the case to trial in charge of the defendants:

1. Yahia Yussef (alias Kamal Kamil), accused of committing the criminal offenses "Aiding illegal border crossing", "Structured criminal group", "Commitment of criminal offenses by a criminal organization and a structured criminal group", provided for respectively from articles 298 paragraph 1, 28 point 4, 333/a first paragraph and 334 point 1 of the Criminal Code.

2. Soran Saber, accused of committing the criminal offenses "Aiding illegal border crossing", "Structured criminal group", "Commitment of criminal offenses by a criminal organization and a structured criminal group", provided for by articles 298 paragraph i first, 28 point 4, 333/a first paragraph and 334 point 1 of the Criminal Code.

3. Yalcin Ali Hanci, accused of committing the criminal offenses "Assistance for illegal border crossing", "Structured criminal group", "Commitment of criminal offenses by criminal organization and structured criminal group", provided by articles 298 paragraph first, 28 point 4, 333/a first paragraph and 334 point 1 of the Criminal Code.

4. Mustafa Koseoglu, accused of committing the criminal offenses "Aiding illegal border crossing", "Structured criminal group", "Commitment of criminal offenses by a criminal organization and a structured criminal group", provided respectively by articles 298 paragraph first, 28 point 4, 333/a second paragraph and 334 point 1 of the Criminal Code, making available to him a panel composed of three judges, different from this monocratic body, for the reason that the court considers that there is evidence sufficient to support the charge.

II. Based on Article 332/e of the Penal Code, the trial fascicle must consist of all the acts presented by the prosecutor, there are a total of 52 volumes, excluding from them the minutes with the statements of the persons who have knowledge of the criminal offense, with the statements of the persons questioned in the capacity of the person against whom investigations are conducted or in the capacity of the accused person, in the conditions that during this trial no request for a summary trial was submitted, and they cannot be used directly in the trial.

III. Court costs as incurred.

IV. It is ordered to deposit this decision and the fascicle of this judgment in the Chief Secretariat of this court within 10 (ten) days, starting from the day after the announcement.
