Journalist Blendi Fevziu has commented on the Constitutional Court's decision that dismissed Prime Minister Edi Rama's lawsuit regarding the suspension of Deputy Prime Minister and Minister of Infrastructure and Energy, Belinda Balluku, emphasizing that the essence of the issue was not only related to this specific case.
According to Fevziu, the Constitutional Court's decision has a broader scope than the initial interpretation that focused on Balluku. He believes that the court has sanctioned the constitutional right of SPAK to request the Special Court to suspend ministers under investigation, while the final decision-making belongs to the court.
Fevziu emphasizes that this logic does not exclude the head of government either. According to him, from this moment on, even the prime minister can be subject to a suspension measure, if SPAK presents evidence and the court deems it sufficient.
"In the early hours of the morning, I learned about the decision of the Constitutional Court in the case that confronted the Albanian government with SPAK, regarding the Balluku case. I learned about it late because I have a time difference, I am on the border between Afghanistan and Pakistan at the moment. Most of the news that I read, especially those that I read on social networks, create a kind of confusion because we are talking about the suspension of Balluku. In fact, the issue did not mention, or did not center on the suspension of Balluku. Of course, this decision of the Constitutional Court leaves in force the decision of the Special Court for the suspension of Belinda Balluku from duty, but the main problem is that from this moment on, with a decision of the Constitutional Court, SPAK and the Special Court have the constitutional right, so SPAK can request the Special Court to decide, the suspension of any minister who is under investigation and there is sufficient evidence that he has committed corruption or other criminal acts. Of course, it is the court that evaluates this, but since "At this moment, any minister of the Albanian government, including the prime minister, can be suspended by the Special Court upon SPAK's request based on the facts that SPAK will send. It is not a suspension of Balluk, but it is a green light to suspend any minister of the Albanian government, including the prime minister, by decision of the Special Court," said Fevziu.
