
The Special Board of Appeal, KPA decided on Friday, February 2, to review one of the three denunciations filed against the Gjirokastra prosecutor, Julian Çafka, by the citizen A.LL. on January 22, a few days before the previous hearing. At the beginning of the public session at the College, the Public Commissioner, Florian Ballhysa, stated that the contents of two of the three denunciations were part of a denunciation made in November 2021 against the subject, which were reviewed and did not become part of the appeal.
Regarding the third denunciation filed in the College in January, in which it is claimed that Çafka has favored the crime and has not punished it, although the state is financially damaged, Ballhysa notes that this matter has been examined by the Commission and referred for inspection to the High Inspector of Justice. He added that for this issue he expressed himself in the appeal, requesting that it be taken into a summary assessment, in function and other possible findings, resulting from the review of the issues.
Prosecutor Çafka stated that two of the reported cases were not investigated by him. Regarding the claim raised for not starting the investigation for the third case and that this decision was overturned by the court, he said that he had brought as evidence the request for a trial for the defendants. The subject claimed that there could be inaccuracies in the bundles, but that they had occurred as a result of the extreme conditions in which they worked, since the Gjirokastra prosecutor's office had only one prosecutor left and the workload was quite large.
Çafka described the denunciation as illegitimate, claiming that it was carried out for personal reasons. However, he said he was open to investigation.
After withdrawing, the panel of the College decided not to continue the examination of the two denunciations with the argument that they do not meet the conditions. In the function of the third denunciation, it was decided to request the administration of the lottery for the assignment of this case, as well as the decision-making acts of non-starting.
Also, it was reported that the same informant, citizen A.LL., had filed another denunciation which turned out to have been sent before, as a result of which it was decided not to administer the acts. The next session was postponed to February 23, at 10:00.
Prosecutor Julian Çafka was confirmed in office by the Independent Qualification Commission on September 14, 2021, after several cases denounced by the public, where deficiencies were found in the investigations carried out, as well as the doubts raised by the Directorate of Classified Information Security, were not found penalizing. Meanwhile, the KPK decided to transfer to the High Inspector of Justice two cases investigated by prosecutor Çafka in 2018 and 2019, for inspection of the causes that may constitute disciplinary violations. / BIRN
