The Elbasan Prosecutor's Office reacted to the incident in the Peqin prison, where Sokol Mjacaj, sentenced to life imprisonment, killed Arben Lleshi with a gun and injured Indrit Shaqjan.
The firearm, 5 cartridges and 2 damaged shells were seized at the scene. After the murder of Arben Lleshi, Sokol Mjacaj, threatening the prison employees with a weapon, was isolated in the premises where the meetings were held with family members.
According to the investigations, Sokol Mjacaj kept the pistol inside his cell for about 20 days, while it is not yet known how he managed to get the weapon into the prison premises. For him, the charges for the criminal offenses of "Murder in qualifying circumstances" of which one remains pending, "Carrying and production of weapons, explosive weapons and ammunition" are aggravated.
While the director of the prison of Peqin and 11 employees of the chain of command are being investigated for "Abuse of duty" and "Introduction or keeping of items in the institution of execution of imprisonment decisions" provided by articles 79/dh, 278/1, 248 and 324/a/2 of the Penal Code.
Notice of the prosecution:
From the execution of investigative actions up to these moments, it results that: On 15.12.2023 at around 13:52 in the premises of the internal regime of IEVP Peqin, the citizen (sentenced to life imprisonment, designated by court decision high security) Sokol Mjaca fired a pistol at the citizen (convict) Arben Lleshi and Indrit Shaqja, leaving the victim Arben Lleshi dead on the spot and the victim Indrit Shaqja injured. After that, this citizen threatened the service employees with a firearm in his hand, and then he was isolated with a gun in his hand in the premises of meetings with family members in this prison. As material evidence, a firearm, 5 cartridges, and two damaged shells were seized.
From the performance of the first investigative actions, specifically the examination of the scene, the statements received, the questioning of the person under investigation Sokol Mjaca and the written documents administered until these moments, the firearm was brought to the IEVP Peqin and then kept in room from the convict Sokol Mjaca for a period of about 20 days. Also, this weapon is suspected to have been carried by him in the common areas of this prison (ventilation, or internal regime).
Following the investigative actions, there are reasonable suspicions that the service employees did not fulfill their functional duties, as they did not carry out the physical check, which consists of the prisoner leaving the room for ventilation and returning from the ventilation to the room on the day of the event as and in the previous days. Also, during the transfer from the premises of the building named as 41 biz where he was accommodated to the high security building B where the convict Sokol Mjaca was recently accommodated, it turns out that the standard procedure of physical control and personal belongings was not carried out as stipulated the security scheme, as well as the information authorities of the prison, the event that happened at 13:52 on 15.12.2023 in the operating room of DVP Elbasan or Peqin Police Station was not notified.
On this basis, the judicial police has arrested a citizen in flagrante delicto:
• Sokol Mjaçaj alias Mjacaj, son of Fran and Tone, dated 14.02.1995, born and resident in Shkodër, Nj. Adm. Saddle, education 9 years, profession unemployed, civil status single, judicial status sentenced to life imprisonment and serving the sentence in IEVP Peqin, as a suspect for the criminal offenses "Murder in other qualifying circumstances", one of which remains in attempts, "Carrying without permission and the production of weapons, explosive weapons and ammunition" and "Introduction or keeping of prohibited items in the institution of execution of prison sentences", provided by articles 79 points dh and 22, 278/1 and 324/a/2 of the Criminal Code.
Also, by the Decision of the Prosecutor of the case, the detention of the following citizens as suspects of a crime, specifically, was ordered:
1. K.H, acting director of IEVP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not take the appropriate legal measures for the management of security in the prison, severely compromising security in this institution.
2. Q.M, with the duty of Head of the regime, building 41 Bis, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not comply with the legal obligations defined in the prison security scheme for conducting the control of the convict Sokol Mjacaj from building 41 bis in sector B.
3. N.Gj. on duty, the former head of security of IEVP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not take the necessary measures to prevent the entry into the internal regime of the weapon the fire with which the murder was committed.
4. A.D., with the duty of Information Specialist, operating room IEVP Peqin, as he is suspected of committing the criminal offense of "Misuse of duty" provided for by Article 248 of the Penal Code, as he did not perform his duty by not notifying the operating room of State Police for the incident.
5. I.B., with the duty of service worker Godina B, IEPP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not exercise the mandatory procedure of checking the convict Sokol Mjacaj .
6. F.M., on duty as police officer at building B, IEPP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not exercise the mandatory procedure of checking the convict Sokol Moan.
7. F.P, duty police officer, in charge of the first floor sector, building B, IEPP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he has not exercised the procedure of mandatory control of the convict Sokol Mjacaj.
8. V.Sh., acting head of regime building B, IEPP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not take the necessary measures to guarantee compliance with control procedures in the sector he directs.
9. G.M, on duty in the column, building B, IEVP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not exercise the mandatory procedure of checking the convict Sokol Mjacaj.
10. K.H, with the duty of a basic role employee, building B, IEPP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided for by Article 248 of the Penal Code, as he did not exercise the mandatory procedure of control of convicts Sokol Mjacaj.
11. E.Ç, with the duty of service police, building B, IEVP Peqin, as he is suspected of committing the criminal offense of "Abuse of duty" provided by article 248 of the Penal Code, as he did not exercise the mandatory procedure of control of convicts Sokol Mjacaj.
