While there is talk of actions against unauthorized construction and protection of the territory, in practice the opposite picture results: lack of inspections, unimplemented decisions, unfinished penalties and millions of lek in uncollected obligations. Although Prime Minister Edi Rama has continuously articulated the need for territorial protection and has undertaken a broad campaign to free public spaces and demolish unauthorized constructions, an audit by the Supreme State Audit Office (SSA) highlights deep problems in the functioning of the National Inspectorate for Territorial Protection (IKMT).
According to the report, IKMT has not been effectively engaged in carrying out the necessary inspections, even in cases where there have been reports from other public institutions of illegal construction in areas of national importance, including protected areas, the coast or cultural heritage. In many cases, the institution lacks minutes to ascertain violations, failing to follow up with decisions to suspend works, demolish buildings or impose fines.
The report also highlights that a significant number of decisions to demolish illegal buildings have remained unexecuted by the relevant IKMT structures, despite the fact that administrative acts have been issued. This situation, according to the audit, has influenced the growth of informal constructions, which in some cases have subsequently entered the legalization process, also benefiting from plots on public property, including areas with tourist potential.
In cases where violations were found for unidentified persons, inspectors did not conduct re-inspections to monitor the progress of the works or to identify those responsible. Also, in some administrative procedures, IKMT did not follow the legal steps to request the court to issue execution orders, leading to delays and a decrease in the effectiveness of punishment.
The SAI also notes problems in the formulation of decisions to suspend works, where the deadlines (15, 30 or 60 days) were set without documented technical or legal justification, violating the principle of proportionality. In some cases, after the expiration of these deadlines, subsequent inspections were not carried out to verify whether construction had stopped.
Deficiencies have also been identified in the administration of fines. According to the report, the procedures for their notification, execution and collection have not been consistently followed. For some punished entities, documentation for subsequent inspections is missing, while for 5 fine decisions worth around 43.6 million lekë, the execution order was not requested from the court within the legal deadlines.
Another finding is related to the non-prosecution of cases of illegal construction. From the audit of 32 files containing elements of the criminal offense of “illegal construction”, it results that IKMT has not requested the initiation of criminal proceedings, even though the violations are considered serious. In total, during the period 2020–2024, 935 decisions were issued for the demolition of illegal buildings, but not in all cases were they accompanied by criminal charges. So, the builders who added floors were amnestied.
The report also highlights a lack of documentation in the process of executing decisions. In 7 cases, demolition decisions were not accompanied by documented minutes or photographic evidence, undermining the transparency and traceability of administrative actions.
In financial terms, the situation appears problematic. By the end of 2024, total liabilities will reach over 1 billion lek, while outstanding liabilities for this year alone are around 536.8 million lek, mainly from final court decisions for damages after the demolition of buildings. According to the SAI, these liabilities have burdened the institution's budget and have not been liquidated according to standard financial methods.
The audit findings raise questions about the effectiveness of the structures responsible for protecting the territory, at a time when public actions against unauthorized construction have been presented as a government priority. / Pamphlet
