What was not said in Serbia about the case of Radoicic?

Free, but without a passport - this is how Milan Radoicic's status in Serbia can be described for now, after the court in Belgrade released him from detention on October 4. The day before, the police sent him to be investigated at the High Public Prosecutor's Office in Belgrade, in connection with the armed attack on the Kosovo police in the village of Banjské in Zveçan, on September 24.

Radoicic himself, through his lawyer, took responsibility for the attack, which Kosovo describes as a terrorist act and an attempt by Serbia to subvert the constitutional order. However, Serbia, which does not recognize the state of Kosovo and its institutions, considers the criminal acts different from the official Prishtina. Among the crimes that Radoicic is charged with in Serbia, there is no terrorism, nor murder of a policeman.

According to the Serbian Prosecutor's Office, Radoicic is suspected of several criminal offenses related to the illegal purchase of weapons and "causing general danger".

The lawyer from Belgrade, Bozho Prellevič, says that the procedure against Radoicić "has nothing to do with the law". Prellevič says that the statements of the prosecution and the court do not look like they were written by professionals, but "marketing experts".

"Radoicic comes out and says that he organized the attack and the group, and the crimes he is charged with are different," says Prelleviq for Radio Free Europe.

In the open letter to the public, Radoicic admitted that he had organized an armed group and that he was in Banjska on September 24.

What does Serbia charge Radoicic with?

According to the announcement of the High Court in Belgrade, Radoicic is charged with several criminal offences. The first concerns the production, possession and illegal trafficking of weapons and explosives. The prosecution also charges him with possession of weapons without a permit. According to her, Radoicic is suspected of having provided weapons, ammunition and explosive devices of great destructive power from Tuzla to Bosnia and Herzegovina from January 2023 to September 24.

For this criminal offense, the prison sentence is from two to twelve years. The Serbian prosecution also believes that Radoicic is the "leader" of the group that committed the crime - for which the prison sentence goes up to eight years. However, it does not treat the attackers in Banjska as an organized criminal group, nor Radoicic as its organizer.

Radoicic is also charged with a serious offense against general security, namely causing a general danger, after which "the death of one or more persons occurred". The maximum penalty for this offense is also 12 years in prison.

Radoicic, as announced on October 3, denied guilt for all these acts, although he previously accepted responsibility for the attack in Banjska. In the first days of the investigation, the authorities in Pristina identified Radoicic as a participant and main organizer of the armed group and then presented evidence that, according to them, proves this. In addition to footage from drones, a large arsenal of weapons and other equipment captured in Banjska was also presented.

"Procedure against Radoicic due to pressure from the West"

According to the lawyer Prellevič, Serbia has started proceedings against Radoicić because of his "external political appearance". The European Union asked Belgrade to cooperate in the investigation of the attack in the north of Kosovo, stressing that the mandate for this investigation belongs to the Kosovo police. On October 3, the European Parliament strongly condemned the attack in Banjska and the West agrees with the description of the Kosovo authorities as "terrorist".

Lawyer Prellevič says that Serbia had to arrest Radoicić to say that he was not part of that attack and that he is "fighting against it". According to him, the whole procedure takes place due to pressure from the West, but, on the other hand, "due to the possible elections, Radoicic should not be in custody".

Në reagimin e parë pas sulmit në Banjskë, presidenti i Serbisë, Aleksandar Vuçiq, tha se sulmuesit ishin serbë vendas nga Kosova, “të cilët nuk mund ta duronin më terrorin e [kryeministrit të Kosovës, Albin] Kurti”.

Rreth një javë më vonë, më 2 tetor, ai tha se të gjithë ata që morën pjesë në sulmin ndaj policisë së Kosovës, do të mbajnë përgjegjësi para institucioneve dhe se këtu përfshihet edhe përgjegjësia e Radoiçiqit. Në disa raste, Vuçiç e mohoi përgjegjësinë e Serbisë.

Lirohet pavarësisht kërkesës së prokurorisë

Pas refuzimit të kërkesës së prokurorisë për ndalimin e Radoiçiçit, Gjykata e Lartë në Beograd, më 4 tetor, ia ndaloi atij të largohej nga vendbanimi dhe ia konfiskoi pasaportën. Atij iu ndalua edhe shkuarja në Kosovë. Prokuroria tha se do ta apelojë vendimin e gjykatës.

Radoiçiç e bëri deklaratën e tij të parë para institucioneve të Serbisë “në cilësinë e qytetarit”, më 30 shtator - një ditë pasi e mori publikisht përgjegjësinë për Banjskën. Nuk është e qartë se çfarë tha atë ditë në polici. Tri ditë më vonë u ndalua dhe dha deklaratë si i dyshuar. Sipas deklaratës së Prokurorisë së Lartë Publike të Serbisë, të datës 3 tetor, Radoiçiç e mohoi kryerjen e veprave penale me të cilat ngarkohet. Avokati i tij mbrojtës, Goran Petronijeviç, tha atë ditë se Radoiçiç ka mohuar se ka kryer vepra penale, por jo edhe gjendjen faktike.

The Minister of the Interior of Kosovo, Xhelal Sveçla, said in an interview for Radio Free Europe that the responsible authorities, through international partners, will request the extradition from Serbia to Kosovo "of all those who were involved in the planning and realization of the action terrorist" in Banjska.

For now, it is not known how Serbia would respond to such a request when it was sent to it, as it does not recognize the state of Kosovo and has no extradition agreement with it./REL
