
Italy's Court of Cassation has concluded that data collected from encrypted communications, such as that of the Sky ECC platform, can be used as evidence in criminal proceedings, as long as it is collected legally and in accordance with standards national and international.
This decision emphasizes that it is important to respect procedural principles and the fundamental rights of individuals, maintaining a balance between the protection of privacy and the need to ensure public safety.
The Court has also emphasized the importance of international cooperation and has legitimized the exchange of data between foreign authorities for investigations related to organized crime. The assessment of the proportionality of the interference in the privacy of individuals is done when there are strong indications of serious criminal activities. This decision also highlights the important role that encrypted technologies play in the fight against modern criminality and the need for advanced tools to deal with these activities.
The decision of the Italian Court of Cassation comes at a time when in Albania the debate on the use of advanced technologies for the investigation of crime is in the center of attention, bringing the need for a careful balance between security and respect for human rights.
