46.3 percent voted (For) and 53.6 voted (Against)...
The referendum initiated by Prime Minister Giorgia Meloni, to approve the Constitutional amendments that reformed the justice system, has failed. The majority of the over 27 million Italians who participated in this referendum said 'NO' to the changes approved by the 'Meloni' government. 46.3 percent voted (Pro) and 53.6 voted (Against).
This defeat is expected to negatively affect Meloni's government. Many have raised the idea that the country should go to early elections.
In his first statement after the results were released, Meloni himself said that he respects the decision of the Italian people.
" We respect the decision of the Italians and we will move forward ," Meloni said in a brief reaction.
On the other hand, Matteo Renzi stated that the failure of the referendum should not go without consequences. Renzi proposed that when a referendum is lost, one should resign, something he stressed that he had done himself before. He added that it remains to be seen whether Meloni will have the courage to resign.
"It seems to me that the game is basically over, the percentage is 45 to 54, and the consensus will be more or less the one that has emerged over the hours, amidst numerous conversations. The No vote, surprisingly, won this referendum. When the people speak, the government must listen. I am not saying what Giorgia Meloni should do; I resigned. I know personally how painful it is to lose a constitutional referendum, but losing and leaving with a whistle is not an option. We will see if she has the courage to resign , "said Renzi.
Meanwhile, the leader of the 'FdI' group in the Chamber of Deputies, Galeazzo Bignami, commenting on the referendum result, said that he does not expect it to have an impact on the fate of the government.
" I've known Giorgia Meloni for some time and I don't remember her ever walking away from a political battle. So I didn't expect her to do anything different than what she did, because Giorgia Meloni always shows her face openly. I don't think there's any doubt about that ," Bignami said.
The opposition, on the other hand, has called the rejection of the referendum a victory.
" We did it. We did it! Long live the Constitution! ", wrote M5S leader Giuseppe Conte on X.
"A victory for the Constitution and the Italian people!" Andrea Orlando wrote on social media.
On the other hand, many Milanese magistrates gathered in the hall of the Milan branch of the National Association of Magistrates (ANM), on the first floor of the Palace of Justice, to await the result of the referendum on justice reform, which they welcomed with applause.
We recall that in the two days of voting, 27,078,025 citizens with the right to vote participated, or about 58.93 percent of voters. 46.3 percent voted (YES) and 53.6 voted (NO).
The ballot papers asked: “ Do you approve the text of the law revising Articles 87, paragraph 10, 102, paragraph 1, 104, 105, 106, paragraph 3, 107, paragraph 1 and 110 of the Constitution, adopted by Parliament and published in the Official Gazette of October 30, 2025, under the title “Provisions on the Judicial System and the Establishment of the Disciplinary Court?” The options were “YES” and “NO”. This was a confirmatory referendum: it did not require a quorum, it decided by a majority of valid votes.
The magistrate system remains unchanged.
The judiciary remains an "autonomous body, independent of all other powers", as defined by the current article 104, without a rigid division between judicial and prosecutorial careers. Transitional provisions for the implementation of laws do not enter into force for a year, blocking any transition to new bodies. Technically, the system avoids turmoil, while maintaining the functional unity of magistrates.
The Supreme Court and disciplinary powers
The High Council of the Judiciary (HCJ) remains the only self-governing body, with direct elections by magistrates and without random selection of lay members from parliamentary lists. The current disciplinary section manages the proceedings, avoiding the creation of a High Court with 15 mixed members (professionals, lay members and randomly selected). Recruitment, transfers and evaluations remain the exclusive prerogatives of the HCJ, without fragmentation.
Career and constancy
Magistrates are admitted through a single competitive examination and can move from the position of judge to that of prosecutor, within the limits of the Cartabia reform of 2022. Permanent appointments remain guaranteed by the single CSM, without separate councils for each function. Access to the Supreme Court of Cassation is privileged for judges, without promotion for prosecutors with 15 years of service.
Disciplinary and procedural system intact
Disciplinary procedures follow current regulations, with appeals to the Supreme Court under Article 111, without any restrictions on domestic courts. CSMs retain full powers, including transfers and assessments, avoiding reductions in remaining roles.
