
A federal judge appointed by Donald Trump has dismissed an extraordinary lawsuit filed by the Trump administration's Justice Department against all 15 federal judges in Maryland, calling it an "unprecedented constitutional clash."
The decision, signed by Judge Thomas Cullen, emphasizes that the executive branch has no legal right to sue the judiciary for exercising its functions.
"The administration has undertaken a campaign to smear federal judges, calling them 'radicals,' 'corrupt,' 'crazy,' and 'unconstitutional.' This deliberate attack on the judiciary is unprecedented and detrimental to the rule of law," Cullen wrote in the 39-page ruling.
How did the collision start?
In June, the Justice Department sued all of Maryland's District Court judges after the court's chief judge instituted a new rule: any immigrant who sued for deportation automatically gained a temporary stay of deportation until the case was reviewed.
The move was seen by the administration as a setback to its rapid mass deportation plan. The latest case was that of Kilmar Abrego Garcia, who was illegally deported to El Salvador and then returned to the U.S. The Maryland court ruling protected him from immediate deportation.
Cullen stated that: The government has no right to sue judges for the exercise of their functions. Federal judges enjoy absolute immunity from lawsuits by the executive branch.
" A lawsuit by the executive against the judiciary for exercising judicial power is not normal and will not be set as a precedent by this court ," he said.
He added that any attempt to create "a new precedent" would be a violation of the American constitutional order.
This decision is a serious blow to Trump's campaign to control the speedy deportation processes, which have caused constant clashes between the courts and the administration.
Moreover, the fact that the judge who dismissed the lawsuit was appointed by Trump himself gives the decision double political weight: evidence that even among conservative judges there is concern about the executive's aggressive interference in the judiciary.
