A decision of the Constitutional Court not to accept the government's request to complete the previous decision of this court that abolished the 15% taxation of free professions, seems to have closed the doors to the compensation of the entities that had prepaid the first installment.

Rejecting the government's request that the constituent state express itself about the effects produced by its decision given in June of this year, the Constituent Court has underlined that the said decision entered into force after publication in the official notebook.

In other words, there will practically be no compensation for 6,541 subjects of free professions, who had prepaid about 5 million euros in income tax.

A decision of the constitutional court for not accepting the government's request to complete the previous decision of this court that abolished the 15% taxation of free professions, seems to have closed the doors to the compensation of the entities that had prepaid the first installment.

Rejecting the government's request that the assessee express the effects of its decision given in June of this year, the assessee court has underlined that the decision in question came into force after publication in the official gazette.

In other words, there will practically be no compensation for 6,541 subjects of free professions, who had prepaid about 5 million euros in income tax.

On the same day, September 16, 2024, when the Constitutional Court issued the decision in question, the deputy of the Democratic Party, Jorida Tabaku, filed a draft law in the assembly to compensate freelancers who have prepaid 15% profit tax, as well as the deletion from the system of tax obligations of along with interest arrears that have been created by the implementation of the repealed law for several months.

It remains to be seen whether this proposal will be accepted by the majority, but the second constitutional decision for the entry into force of the decision to abolish taxation after publication in the Official Gazette is a strong stone in the government's hand to not compensate those self-employed professionals who paid the first installment of personal income tax in advance.
