Will SPAK survive?

Will the next sacrifice be SPAK which will be executed by the Rama-Berisha binomial?

SPAK has been targeted by the opposition for a long time, since the time when the Chairman of the Democratic Party is under investigation by him. In fact, it seems as if the only goal of the DP is the daily attack on this institution, due to the conflict of interest of its chairman. All the energy of the opposition is unfortunately focused in this direction. Leaving behind other issues and political strategies that could make him a winner in the next election.

In fact, this institution faces several challenges and issues on which its future will depend. Depending on how he behaves, he will either be discreet or he will truly become a hope for Albania's future. The fact is that the issues investigated by him have become a problem for Albanian politics, both on the left and on the right.

For this reason, there is an open political war against SPAK in different ways. Some open and public, some underground. One of these, for example, is the famous Xhafaj anti-corruption commission, which is suspected of having intentions to slow down SPAK's activities.
It is normal for politics to be in conflict with justice, it has always been so. Because the two powers share different goals. Even more so in Albania, where the 34-year-old political class is perceived by the citizens as corrupt.

The question is who will win this battle? The question is whether this political class or SPAK will survive. Because both together, in all probability, cannot coexist.
It was strange how in 2016 the Albanian parliament unanimously voted for the Reform in Justice. Strange given that she was a justice who was supposed to investigate the political class that voted for her. It seemed like a masochistic act by Albanian politics to set up new bodies of justice, which would deal with 33 years of corruption in Albania. And in fact, corruption has been great. At least this is how it is perceived by the Albanian public opinion and by all the reports that have been developed by reliable international organizations.

It is clear that Albanian politics voted for the Justice Reform, under open American and international pressure. Everyone understands the messages that former American Ambassador Donald Lu sent to the members of parliament to vote for the reform.

And yet, even under American pressure, Albania's political class could not be so self-sacrificing as to approve such a reform that would be used against them. Her hope was precisely the deformation of the reform along the way and during its application.

And so it happened. The Albanian opposition boycotted the Reform, while the majority, being the only political force at the table, tried to influence its bodies, and it did. The lack of a transitional phase of justice and the absence of one of the political parties made this reform in many parts filled with politics.

There is no doubt that in the construction of new bodies, the Socialist Party has its hand in the Reform of Justice. But beyond this influence, the USA and the EU managed to establish new bodies of justice, especially SPAK. Which, despite the government's continuous effort to influence it, has managed to maintain a kind of independence with American support. And he has given the signs of this independence recently with the investigations he has carried out at high levels of power, like never before in 34 years of pluralism in Albania.

It is clear that in the situation where the government and the opposition are today, the only political opponent of Edi Rama and his government is SPAK. If it continues with the rhythms it has taught us recently, SPAK could really be the main problem of Edi Rama's government. In this sense, there is a lack of restraint in his work. To do this, Rama and the government need political allies. And the only ally who has opened up against SPAK and the new justice system is Sali Berisha.

Both are interested in the new justice being stopped and delegitimized. If they can't do it by disrupting the new bodies, then it remains for the SPAK to be restrained in the parliament. For example, by changing the criminal code, or by changing the organic laws of the new justice bodies.

It is not yet known whether the new Rama-Berisha agreement has exactly the new justice as a target. But the danger remains. Whenever the old politics has come together and made non-transparent agreements, this agreement has been at the expense of democracy and justice.

Of the last agreement, the first one he sacrificed was Electoral Reform. It is already clear that there are no open lists. Both presidents consolidated their positions at the head of the party with the law they approved. Will the next sacrifice be SPAK which will be executed by the Rama-Berisha binomial? Their wish is yes, because there is no political class that wants an institution to investigate it. The only hope is American persistence to support this institution. On the contrary, if even Albania's international allies give up this support, very soon SPAK will close its doors.
